Prison Control Agency/ Lamallari: Modern instrument for penal supervision

The Minister of Justice, Besfort Lamallari, was present today at the meeting of the Committee on Internal Affairs and Defense, where the draft law "On the Supervisory Agency in the System of Execution of Criminal Decisions" was reviewed.

In his speech, Lamallari stated that it is important to create a new legal framework to strengthen control, transparency and professionalism in the system of execution of criminal decisions.

“The draft law aims to create a modern and functional structure, which will guarantee effective supervision of the institutions for the execution of criminal decisions, in accordance with the Constitution and international standards of criminal justice. The new agency will have the mission of preventing, detecting and investigating criminal offences within the system, as well as strengthening internal control mechanisms to guarantee institutional integrity. The Ministry of Justice stands by the version of the draft law approved by the Council of Ministers. This draft has had sufficient time to be consulted on every letter of it. In the draft law, a special emphasis is given to the investigative intelligence activity, which will be carried out in accordance with the legislation in force and on the basis of common inter-institutional guidelines, guaranteeing respect for fundamental rights and freedoms. The draft law provides for additional mechanisms for the protection of personal data, in accordance with the relevant legislation, as well as the request for authorization from the prosecutor before obtaining data from operational employees, in order to avoid any possible abuse. This initiative is an important step towards "consolidating a safe, transparent and accountable system of execution of criminal decisions, in the service of the rule of law and citizens' trust in institutions", said Lamallari. /CNA
