This Monday, the hearing for the head of the KLP, Alfred Balla, will be held at the Special Appeals College.

Alfred Balla will appear at 10:00 a.m. in front of the jury after the Public Commissioner complained about the end of the vetting by the Independent Qualification Commission.

We recall that the head of the KLP avoided the vetting process and for this he was helped by the KPK.

Let's recall the facts one by one.

Alfred Balla underwent the re-evaluation process due to exercising his duties as a legal assistant in the Supreme Court until July 31, 2017.

According to the legislation in force, he was subject to vetting due to his work as a legal assistant in the Supreme Court until July 31, 2017 and had to undergo the reassessment process.

For Alfred Balla, there was a "clash" between the KPK and the internationals (OMN). Balla claimed that his vetting procedure as a councilor should be stopped without a final decision, as he was dismissed by the head of the Supreme Court in July 2017.

Observers of the International Monitoring Operation expressed their determination that Balla should undergo the re-evaluation process.

But the KPK ignored the internationals and after several maneuvers by Alfred Balla, favored the latter.

It should be mentioned here Balla's maneuvers with e-mails, the lawsuit in the Administrative Court and the request in the KLJ, for the recognition of the status of the Counselor/Assistant non-magistrate at the Supreme Court.

The vetting process was taking place in parallel with the judicial proceedings in the Administrative Court of Appeal. The latter decided in March 2023 to overturn the decision of the First Instance and dismiss the lawsuit, and in February 2023, the current head of the KLP waived the lawsuit and submitted to the Supreme Judicial Council a request for renunciation of recognition/ having the status of Counselor/Legal Assistant at the Supreme Court.

After that, the KPK decided that Balla was no longer subject to re-evaluation and closed the process without a final decision.

Two of the members in the majority in the KPK, chair Xhensila Pine and relator Alma Faskaj, reasoned that Balla had not resigned and that he had lost his status because he was dismissed by the head of the Supreme Court in July 2017.

Thus, they also avoided the sanction against Balla that prohibits him from being appointed to several positions in the justice system for 15 years, including the position he currently holds.

However, the Public Commission did not agree with this decision and decided to appeal. Thus, Balla will have to account for wealth, clean image and professional skills.
