Rama's agreement with Meloni is personal and not structural

According to the provisions of the law on international agreements, cited below, it is not:

1. Instrument drawn up according to public international law,

2. Approved in principle by the Council of Ministers before its signature

3. Negotiated and signed against the "Power of Attorney" issued by the competent authority

4. Prepared by ministries, institutions and public entities defined by law

5. Signed with authorization issued by the President of the Republic.

6. Prepared by the competent ministry for the implementation of the agreement

7. Based on the opinions of the ministries and institutions concerned, and necessarily of the Ministry of Foreign Affairs, the Ministry of Justice, the Ministry of Finance and the Ministry of European Integration

8. Accepted by the interested ministries and institutions against a relation that contains:

a) the reasons, purpose and object of the agreement;

b) priorities and expected results;

c) the financial effects resulting from its implementation;

ç) compliance with the Constitution, internal legislation and international law binding on the Republic of Albania, as well as with the acquis of the European Union;

d) the evidence and the reasons for taking the necessary legal measures that must be approved for the implementation of the international agreement, as well as the authority responsible for their preparation.

9 – Negotiated by a delegation determined by the competent ministry with representatives of the interested ministries.

10. Approved in principle, by the Council of Ministers, with the proposal or co-proposal of the competent ministry/s, after negotiations where the following have been presented:

a) draft decision for approval in principle;

b) the text of the agreement in the negotiated language;

c) the text of the agreement, translated into Albanian and certified by the Ministry of Justice;

ç) opinions of interested ministries and institutions;

d) explanatory report, according to point 4, article 8, of the law on international agreements.

11. Determined whether it enters into force with signature or will be ratified

12. Specified that it will be treated by the norms of international law, mandatory in the Republic of Albania, due to the groundlessness in the law on agreements.

"On International Agreements in the Republic of Albania", as follows:

Article 3 - Definitions

dh) "International agreement" is the instrument drawn up according to public international law, which is binding between the state institutions of the Republic of Albania and other states or international organizations, regardless of its form and name.

e) “Miratim në parim” është akti, me anë të të cilit Këshilli i Ministrave miraton projektet e marrëveshjeve të paraqitura nga ministritë kompetente para nënshkrimit të tyre.

f) “Plotfuqi” është dokumenti që lëshohet nga autoriteti kompetent i Republikës së Shqipërisë, që autorizon një ose disa zyrtarë të përfaqësojnë shtetin apo Qeverinë në zhvillimin e negociatave, parafimin dhe nënshkrimin e një marrëveshjeje ndërkombëtare.

Neni 4 - Përgatitja e marrëveshjeve ndërkombëtare

Projektet e marrëveshjeve ndërkombëtare përgatiten nga ministritë, institucionet qendrore e vendore, si dhe entet publike, në përputhje me Kushtetutën, të drejtën ndërkombëtare të detyrueshme për Republikën e Shqipërisë dhe legjislacionin shqiptar në fuqi.

Neni 5 - Subjektet e marrëveshjeve ndërkombëtare

2. Marrëveshjet ndërkombëtare në emër të Republikës së Shqipërisë mund të nënshkruhen nga Presidenti i Republikës ose nga Kryeministri, anëtarët e Këshillit të Ministrave apo çdo zyrtar i lartë, në çdo rast me autorizim nga Presidenti i Republikës.

Neni 8 - Propozimi i projektmarrëveshjes ndërkombëtare

2. Kur palët kanë rënë dakord për nevojën e lidhjes së një marrëveshjeje ndërkombëtare, ministria kompetente për zbatimin e marrëveshjes përgatit projektin që do t’i propozohet palës tjetër.

3. Për hartimin e projektmarrëveshjes, ministria kompetente merr mendimet e ministrive dhe institucioneve të interesuara, si dhe në çdo rast mendimin e Ministrisë së Punëve të Jashtme, Ministrisë së Drejtësisë, Ministrisë së Financave, kur marrëveshja ka efekt financiar, si dhe Ministrisë së Integrimit Europian, kur marrëveshja ka lidhje me acquis të Bashkimit Europian.

4. Kërkesa për mendim shoqërohet nga projekti në gjuhën shqipe, i certifikuar, dhe angleze, si dhe një relacion shpjegues, i cili duhet të përmbajë:

a) arsyet, qëllimin dhe objektin e marrëveshjes;

b) përparësitë dhe rezultatet e pritshme;

c) efektet financiare që rrjedhin nga zbatimi i saj;

ç) përputhshmërinë me Kushtetutën, legjislacionin e brendshëm dhe të drejtën ndërkombëtare të detyrueshme për Republikën e Shqipërisë, si dhe me acquis të Bashkimit Europian;

d) evidentimin dhe arsyet e marrjes së masave të nevojshme ligjore që duhen miratuar për zbatimin e marrëveshjes ndërkombëtare, si dhe autoritetin përgjegjës për përgatitjen e tyre.

Neni 9 - Zhvillimi i negociatave

2. Para zhvillimit të negociatave të drejtpërdrejta, ministria kompetente përcakton përbërjen dhe kreun e delegacionit, kohën dhe vendin e zhvillimit të negociatave. Në përbërjen e delegacionit, krahas përfaqësuesve të ministrisë/ve kompetente, mund të ketë përfaqësues të ministrive të interesuara.

Neni 10 - Miratimi në parim

1. Pas përfundimit të procesit të negocimit, projektmarrëveshja ndërkombëtare miratohet, në parim, nga Këshilli i Ministrave, me propozimin ose bashkëpropozimin e ministrisë/ve kompetente.

2. Propozimi për miratimin, në parim, të marrëveshjes përmban:

a) projektvendimin për miratimin në parim;

b) the text of the agreement in the negotiated language;

c) the text of the agreement, translated into Albanian and certified by the Ministry of Justice;

ç) opinions of interested ministries and institutions;

d) the explanatory report, according to point 4, article 8, of this law, including the arguments for accepting or not the proposals and comments of the ministries concerned.

Article 20 - Entry into force by signature

2. Agreements of a technical nature, within the scope of responsibility of the competent ministry/s and when the parties agree, enter into force upon signature.

Article 37 - Final and transitional provisions

The issues that are not regulated in this law will be handled by the norms of international law, mandatory in the Republic of Albania./ CNA
