Procedural correctness and the shadow of possible Veliaj-Xoxa schemes

The latest case involving Ajola Xoxa and Erion Veliaj pits two elements that rarely go together in Albanian reality: procedural correctness and the shadow of possible schemes.

On the one hand, the stance of the prosecution and the court is, at first glance, exemplary.

By not questioning the medical report and giving consent to travel abroad for medical treatment, the prosecution has chosen a humane and reasonable line.

In a justice system that is often accused of lacking sensitivity, this is a signal that the procedure is not blindly punitive, but also knows how to distinguish situations where life and health must prevail over any other consideration.

But this is where the most interesting, but also most suspicious part of the story begins.

Because if we look beyond the humanitarian facade, a scenario is created that is not at all impossible in Albanian practice, especially considering Erion Veliaj's behavior so far.

If Ajola Xoxa leaves the country for medical treatment and does not return, Erion Veliaj can immediately use this as an argument to request the replacement of the security measure from detention to a lighter form, to take care of the minor son.

And here the essential question arises : are we dealing with a purely humanitarian case, or with a configuration of circumstances that can be exploited strategically?

Because the precedent is known, not necessarily in this form, but in logic. The defendant can create an emergency circumstance, as the specific case presents itself, and then use it as leverage to change the security measure imposed on him.

If this happens, then the correctness of the prosecution and the court, which is essentially to be assessed, risks turning into an involuntary first step in a broader scheme.

This does not mean that Ajola Xoxa's request is untrue or fabricated, as long as there is no evidence to the contrary.

On the contrary, the prosecution and the court have done what they should have done: they have respected a medical report and have shown humanity. But justice does not function only on the basis of individual acts; it must also see the chain of consequences that these acts can produce.

In the end, everything will depend on concrete developments: will Ajola Xoxa return after medical treatment? Will the family situation be used as an argument for Erion Veliaj's release? And above all, will the justice system be able to distinguish between real need and its tactical use?

Because at this point, the game is no longer just legal. It is also a test of the system's ability to avoid becoming part, even unintentionally, of schemes that can be built precisely on its correctness./ CNA
