The public "suicide" of prosecutor Dritan Prençi

The public "suicide" of prosecutor Dritan Prençi

CNA is one of the media outlets that has not stopped publishing, investigating, and denouncing the incinerator issue, but also other highly sensitive files, such as the "5D" file, the file of Mayor Veliaj, etc.

Reports of the scandals, which were mainly received by SPAK, and many responsible persons have gone to the dock to face justice.

One of the most important is the incinerator file, which has not been closed for 5 years by prosecutor Dritan Prençi, who has not even dared to contact and question the mayor of Tirana, Erion Veliaj, regarding this issue.

The incinerator is in Tirana, it was under the administration of the Municipality of Tirana, in the territory of this city in the landfill area where a child's life was lost, that of Ardit Gjoklaj. There are official letters and statements from the mayor regarding this issue, but prosecutor Dritan Prençi seems to be sleeping on this file.

He may be a sleepwalker in this case and perhaps very aggressive with other files, he chooses this himself, but in this case he commits a public "suicide", not only of himself as a prosecutor, but for the reputation he should have, for his colleagues in an institution like SPAK, because it puts the stigma on SPAK that there is a prosecutor who "sleeps".

WHY?

Dritan Prençi shows double standards in how a prosecutor moves quickly on certain cases, while sleeping on a major case involving hundreds of millions of euros in damage and theft.

This raises doubts about his behavior: He is a prosecutor with double standards, it seems, but he may also be incompetent. Then the question arises, how is it possible that he is in SPAK?

Let's take the case of Deputy Prime Minister Belinda Balluku.

Dritan Prençi requested the measure of suspension from office, the argument was simple: it could destroy evidence.

In fact, Belinda Balluku was Minister of Energy and Infrastructure and Deputy Prime Minister.

Dritan Prençi, in normal legal practice, could go to Parliament to request the lifting of immunity, to investigate him while he is free, as the majority claims.

Let's look at a different course of events.

First, Edi Rama removes Belinda Balluku from the position of minister and keeps her as deputy prime minister, what does Dritan Prençi mean?

She is not a minister where the relevant prosecutor claims she will destroy evidence, Rama takes her to another task. It is the prime minister's choice to take her wherever he wants.

Whether he continues in office or not is up to the head of government.

We recall here the case of the former Director of Taxes, Arben Sefgjini, who, although he was under security measures, exercised his duties from home, as he was under house arrest. Erion Veliaj is the mayor, exercising his duties from the Durrës prison.

Dritan Prençi, who requested the suspension measure, what will an ILD or KLP inspection say?

How can a security measure of suspension from duty be requested for a position that is unrelated to the investigation, such as the position of Deputy Prime Minister?

They suspended her from her position as Minister of Infrastructure, but if Edi Rama appoints Belinda Balluku as Minister of Agriculture, what will Dritan Prençi tell us?

Will minister after minister go after him to suspend him from office?

At first, a decision was made in the Constitutional Court, the prosecutor took a second step, requested the lifting of immunity in order to impose another security measure, while the Constitutional Court, without a decision, upheld SPAK's request that Ms. Balluku be suspended from duty.

Balluku is suspended, while Dritan Prençi has requested a more severe measure, removal of immunity, to change the security measure.

The Constitutional Court has granted the suspension (without a decision). What will Dritan Prençi do? Will he give up the second security measure he requested quickly without waiting for the Constitutional Court's decision to become clear?

There are many questions that arise from lawyers, and these are not simply articulated by us as the media, but also by lawyers, constitutionalists, prosecutors, former prosecutors, and judges, who say that there is an impasse here.

A stalemate created by the prosecutor's incompetence.

The prosecutor who sleeps on the incinerators' file invents the suspension from duty, an action that Dritan Prençi seems to have done with political and public protagonism. The incinerators' file "sleeps", the suspension "wakes up"?!

Legal and public impasses, debates born between an institution such as SPAK and the prime minister, created by the incompetence of a prosecutor like Dritan Prençi.

This is a fact, as is Dritan Prenç's inability to follow through on the incinerator issue, where he is afraid to question the mayor of Tirana, who was responsible for the territory where the incinerator was to be built, but was never built.

Without further ado about the receipt and administration of documents and acts found on Ajola Xoxa's computers related to incinerator companies.

This is where the debate about Dritan Prenç's "suicide" begins and ends, whether due to incompetence, "smartness" or other circumstances related to coffee, meetings, negotiations with the Durrës prisoner before he was handcuffed somewhere in the outskirts of Tirana./ CNA
