Presumption of innocence by Prime Minister Rama

In a nearly two-hour speech, Prime Minister Edi Rama, today at the meeting of the Socialist Party Parliamentary Group, delivered a long lecture on justice. At its core was the presumption of innocence, and he told us this as if to a large column coming from the democratic German state.

This country, according to his friend and closest associate and mastermind of Edi Rama, Baton Haxhiu, is one of the most corrupt countries in the world.

Let's move on to the presumption of innocence. The Prime Minister maintained the presumption of innocence for officials, who should stay in office, continue working, accept innocence, etc. He mentioned a case of a minister in France. Very good.

But, the Prime Minister, when he mentions the term of presumption of innocence for officials, there should not be a second standard for criminal groups. How will innocence be presumed, for example, for the Çapjat, for Lul Berisha's group, for those arrested for crimes and murders, those who flee to Dubai and are extradited? Because they are presumed innocent. Why do they imprison them until a court decision is issued? Because they are suspected of having committed a crime, they may repeat the crime, they are suspected of being able to flee and that they may destroy evidence.

 

The “Veliaj” case

Now, in the case of officials, why is Erion Veliaj in prison? Let's take a concrete example. He could have been free, but he went and destroyed the evidence. Erion Veliaj destroyed the evidence, that's why he is in prison. How can Erion Veliaj, who attacked prosecutors and judges from prison by phone and invented two million euros to get him out, be presumed innocent?

Or is he publicly deceiving that prosecutor Ols Dado requested a building permit for an addition? Or was he publicly deceiving that the prosecutor was a DP activist?

Unstoppable public fraud, on the one hand he pays 220 thousand dollars for lobbying and deceiving the US Senate and Congress, on the other hand he has no money to pay for a lawyer, a taxi. How is Erion Veliaj presumed innocent, who has 13 charges and a mountain of files with facts and evidence, which Edi Rama knows very well?!

 

Presumption of innocence in other cases

Prezumimi i pafajësisë në rastet e tjera, sipas Edi Ramës, janë 10 raste korrupsioni, 16 raste shpërdorimi detyre dhe pak raste të tjera për shkelje të barazisë në tenderë. Dhe që i përkasin mandatit të dytë qeverisës të Edi Ramës, as të tretit, as të katërtit. Shumë mirë! Kur ka kaq pak raste korrupsioni, shpërdorimi detyre, përse shqetësohet kryeministri Rama? Përse sulmon prokurorinë dhe SPAK-un në mënyrë të veçantë, apo gjykatat për vendimet? Cila është arsyeja?

Shumë dakord me parimin “më mirë një mijë fajtorë të lirë sesa një i pafajshëm në burg”. Por asnjëri nga këta që është gjykuar për korrupsion, asnjëri nga ata të shpërdorimit të detyrës nuk ka dalë i pafajshëm. Janë dhjetëra kryetarë bashkie për shkelje të barazisë në tenderë, korrupsion apo shpërdorim detyre, që janë futur në burg, shumicën i kanë ndjekur në gjendje të lirë dhe ky është fakt. Edi Rama nuk e mohon dot.

 

Arrestimi i qytetarëve të thjeshtë

Nga ana tjetër, pse ky kryeministër nuk pati të njëjtin reagim për raportin shqetësues të Këshillit të Europës në lidhje me paraburgimin, kur me qindra e qindra shqiptarë u arrestuan për lidhje të paligjshme të energjisë apo për vjedhje korrenti? A nuk i mbushi burgjet me njerëz që lidhnin energjinë elektrike për t’u ngrohur se ishin të varfër?! Nuk po flasim për ata që vjedhin në fabrika apo biznese të mëdha, ata të mbajnë përgjegjësi sipas ligjit. Po a i mbushi burgjet me qytetarë të mjerë kryeministri ynë, që na qan hallin e prezumimit të pafajësisë?! Pse ata nuk ishin të pafajshëm? Ata që nuk kishin bukë të hanin, nuk kanë të drejtë të ngrohen?

Prezumimi i pafajësisë nuk fillon dhe mbaron kur halli të vjen te dera. Shumë mirë që u kap pas pezullimit kryeministri ynë, ka të drejtë. Nuk duhet ta pezullojë zyrtarin që mban detyrën, të shkojë të kërkojë imunitet ose një veprim tjetër. Ka të drejtë kryeministri ynë, por nuk mund të na thotë broçkulla kundër drejtësisë, se duhet të prezumohet pafajësia, duhet të ndiqen në gjendje të lirë zyrtarët.

Kush nga këta? Jorgo Goro, Erion Veliaj, Kristjan Shkreli, cili? Deputetët si Çyrbja, hajdutët si të korruptuarit e tjerë të administratës, të inceneratorëve, drejtorët hajdutë të “5D”-së duhet të ndiqeshin në gjendje të lirë, se prezumohen të pafajshëm?

 

“Simboli” i prezumimit të pafajësisë

Who should we presume to be innocent? Let everyone be presumed innocent, but you cannot be free when you destroy evidence. It is the same as what a criminal can do when he is arrested. When you can leave, it is the same as the criminal can flee the scene. When you can repeat the same theft, corruption or scandal again, it is the same thing that happens to criminals when they kill.

Therefore, with the presumption of innocence, our prime minister is tripping over his own feet, because his officials who are in prison do not have any difference in security measures, because there cannot be double standards. Criminals, as we emphasized above, are put in prison so that they do not repeat the same crime; officials are put in prison precisely so that they do not repeat the same crime. There are officials who have been in office and have continued to repeat the same criminal offenses, or have left Albania altogether, have evaded justice, or have destroyed evidence.

There are dozens of cases and facts, and SPAK is not to blame, nor is the presumption of innocence. Those who commit criminal acts are to blame. Even though, according to Rama, some 30 cases are corruption and abuse of office, and this is in his second mandate, Albania does not have corruption, we are the country that illuminates Europe.
