New regulation for the Guard/ Support for candidates, campaigns and political

The Albanian government has approved several changes and additions to the regulations of the Guard of the Republic of Albania.

Based on this Wednesday's VKM, any Guard employee is prohibited from supporting the campaign of a party, political organization, a member of a political party or an independent candidate, by participating or contributing physically or financially, and from publicly expressing political beliefs or preferences.

Also, according to the new rules, guardsmen cannot run for or be elected to union structures without first resigning from their duties in political positions.

ABOUT

SOME AMENDMENTS AND ADDITIONS TO DECISION NO. 777, DATED 15.12.2021, OF THE COUNCIL OF MINISTERS, “ON THE APPROVAL OF THE REGULATION OF THE GUARD OF THE REPUBLIC OF ALBANIA”

In support of Article 100 of the Constitution and Article 70 of Law No. 33/2021, “On the Guard of the Republic of Albania”, as amended, upon the proposal of the Minister of Internal Affairs, the Council of Ministers

DECIDED:

I. In point 13, of article 158, of the regulation, attached to decision no. 777, dated 15.12.2021, of the Council of Ministers, the following changes and additions are made:

1. The words “… daily must apply the norms of behavior …” are replaced with “… his, applies the rules …”.

2. The letter “dh” is changed as follows:

“dh) not to support the campaign of a party, political organization, a member of a political party or an independent candidate, by participating or contributing physically or financially, and not to publicly express political beliefs or preferences. The Guard employee is prohibited from participating, even if not on duty, in meetings and rallies of political parties, associations and organizations.”

3. After the letter “e”, the letters “ë”, “f” and “g” are added, with the following content:

“ë) Has the right to organize in trade unions to protect his professional interests and the rights defined in the legislation in force;

f) Not to run for or be elected to political positions without first resigning from office;

g) Not to carry out political activities, regardless of whether the activity is carried out in collaboration with a political party or not, and not to carry out activities that constitute a conflict of interest or that may create the impression that the employee of the Guard of the Republic is biased and influenced."

II. The Ministry of Internal Affairs and the Guard of the Republic of Albania are responsible for the implementation of this decision.
