Election date decreed/The saga of complaints and Erion Veliaj's show ends

The President of the Republic, Bajram Begaj, decreed today the date of November 9th for the holding of partial mayoral elections for the Municipality of Tirana.

On this issue, CNA has published two articles. The first article was a report after consultation with lawyers and constitutionalists, who said that the Decision of the Council of Ministers could not be appealed to the Constitutional Court, but to the Administrative Court, since it was previously an action taken by the Municipal Council and that it is an administrative action.

 

Afterwards, lawyer Genc Gjokutaj also said that reviewing this issue is not the competence of the Constitutional Court, but of the Administrative Court.

In fact, Veliaj chose a different path, that of taking the matter to the Constitutional Court simply to argue.

Now, it seems that the saga of complaints and nonsense, with actions more for show than legal truth, has come to an end.

President Begaj has already decreed the election date and the Central Election Commission is expected to begin procedures for registering candidates and launching the election campaign, which will last about 3 weeks.

As warned by the article published by CNA, the arrested former mayor of Tirana, Erion Veliaj, went to the wrong court. According to experts who were asked, when the Municipal Council dismisses the mayor, the Council of Ministers verifies the facts and then seals his dismissal.

Whereas in the case when the Council of Ministers dismisses him, it is the Constitutional Court that verifies the facts. In the case of Erion Veliaj, it is the Municipal Council that dismissed him. So, the request should have been sent to the Administrative Court and not the Constitutional Court.

But, it is understood that Veliaj, even with his 'clever' lawyers, managed to go to the Constitutional Court and blow up the scenario they wanted to create with their own hands, to block the process because they could have done it very well in the Administrative Court and closed the process and blocked it there.

But, since they are very 'skilled' and have been explaining Veliaj's criminal process very well for months with only gaffes and stupidities, it seems they have managed to fail with another 'all-Veliaj' scheme for Strasbourg./CNA
