Horror or comedy, the next one tomorrow at the Constitutional Court

Tomorrow, in the building where the Constitutional Court, the last instance charged with controlling issued acts and their compliance with constitutional provisions, has been installed, the strangest comedy to ever occur since its creation in Albania will be played out.

Unlike what usually happens where the actors are the parties in the constitutional process, this time the main actors are the comedians themselves, known as members of this great court, who have decided that the show in its plenary hall this time will surpass even the intrigues and dramas of Shakespeare's plays and tragedies.

They have called Lali Eri, alias Erjon Veliaj, a former senior official who has been sentenced to prison for 9 serious criminal charges, to be present in the courtroom tomorrow.

So, tomorrow's show is a HORROR that shames the Albanian state. Why does it shame the Albanian state? Because a former high-ranking official, despite his childish courage, cannot enter with the shackles of justice in that hall and nowhere else, only in the criminal justice hall of the GJKKO, which has been authorized by law. This practice is actually more of an ethical issue than a procedural one. But comedians want glory and emotion in the show.

Constitutional justice refers to the set of institutions charged with protecting the legal order of a state. It is otherwise known as the “Guardian of the Constitution.” For this reason, the competence of the Constitutional Court to control the legislative process has been described as the crowning glory of the rule of law.

The tendency to put the activity of the legislature, and of any other body, under constitutional control with clientelistic decisions, judicial precedents is becoming more and more evident every day during this decade, disrespecting the sovereignty of legislators, the authority of state institutions and the fundamental rights and freedoms of the citizens of this country. Therefore, the role of the institution of the Constitutional Court is becoming more and more ridiculous in the eyes of the public. It is difficult to think what internal motive has pushed these judges to undertake such an act that shames the foundations of the rule of law because Erjon Velija I do not think that any right has been violated, he is arrested for the consumption of several criminal offenses that have been qualified by all levels of our courts which have decided that he should remain in the measure of personal security "arrest in prison" and under these conditions he cannot exercise his duty? For this reason he has been dismissed in accordance with the organic law on local governance!

What will the court do tomorrow, overturning all the decisions of the country's courts and reinstating a thief and fraudster proven throughout all the stages of the preliminary investigations set forth by the Criminal Procedure Code as the head of the Municipality of Tirana? Do these judges have any morals who play such soap operas by sending a letter to Erion Veliaj in his cell, as a party to the trial, asking him if he wants to be present at the hearing, without forgetting to also inform the Prisons Directorate "informing it of the date and time of the public plenary hearing, as well as taking measures to accompany Veliaj in case he expresses his willingness to personally participate in the trial."

Erjon Veliaj can move any stone to cover up the effects of his iniquities in public, but a serious institution that is held at the top of the pyramid of judicial power like the Constitutional Court of Albania can never allow itself to desecrate the public interest.

Erjon Veliaj had a public portfolio that was given to him by the Socialist Party and it itself removed it after learning about his exploits in the courts to request his release from prison. While this Nastradini wants to return to office, considering his dismissal illegal, as if he is playing with dolls. Such a mindset surpasses adolescent formation, but this is not our issue, why doesn't Veliaj understand that he received his mandate from the socialists and not from vendors or farmers who cultivate figs.

I cannot fathom who is advising Erjon Veliaj on these reckless ventures that have increasingly diminished him not only in the eyes of his constituents, but also of the socialists, as a fraud and thief unprecedented in the history of the Municipality of Tirana.

Tomorrow I won't be watching the constitutional comedy because it's better to return to Shakespeare or Dante than to listen to the exploits of the idiot in the Constitution Palace.
