The Albanian Helsinki Committee has expressed concern regarding the escalation of the situation during the protest held on July 2 in front of the Parliament. At the conclusion of the field monitoring, the organization denounces the acts of violence committed by specific individuals, but emphasizes that the reaction of the State Police has been inadequate and in violation of legal standards.

AHC says that the right to peaceful assembly is guaranteed by the Constitution and the European Convention on Human Rights. According to the organization, the fact that some individuals commit isolated acts of violence does not take away the peaceful character of the protest as a whole and does not justify the use of force against other participants.

Monitoring shows that the situation was calm for a long time, until the police's behavior changed immediately after the incident with the vehicles on the premises of the Parliament, moving to a cordon and then to tear gas.

One of the most disturbing findings of the AHC is the use of tear gas without prior public warning and without allowing time for the voluntary dispersal of protesters, as required by the Law "On State Police". This measure, according to the Committee, has indiscriminately affected journalists, observers and peaceful protesters, turning into a disproportionate intervention that may constitute ill-treatment.

AHC has also denounced specific cases of the use of physical force, such as rubber batons or blows, against persons who were already neutralized and lying on the ground.

The Albanian Helsinki Committee calls for an immediate, independent and effective investigation into the actions of the police forces during the protest, underlining that the state's obligation is not limited only to allowing the protest, but also to guaranteeing its safe conduct. /CNA
