Assembly's obligation is requested/ DP addresses Constitutional Court regarding investigative committees

The Democratic Party Parliamentary Group has officially filed a request with the Constitutional Court to resolve the dispute over competence with the Albanian Parliament, after the latter refused to establish two parliamentary investigative committees.

In this request, which was signed by 46 MPs and submitted on 03.04.2026, the opposition requests that the Constitutional Court oblige the Assembly to establish investigative committees for the Albanian Road Authority and the National Agency for the Information Society. It also requests that the decisions through which the Assembly overturned the establishment of these committees be declared incompatible with the Constitution.

The opposition argues that Article 77 of the Constitution makes it mandatory to establish an investigative commission when requested by 1/4 of the deputies and that the majority cannot condition this right. They claim that the majority has used an alibi to obstruct parliamentary control, emphasizing that a political investigation is different from a criminal one.

On the other hand, during the parliamentary sessions, the majority argued that the opposition's demands were too broad and evasive, describing them as "fishing expeditions." According to the majority's position, the Assembly cannot interfere with the powers of the judiciary by conducting parallel investigations into matters that are already under investigation. /CNA
