People's Advocate Competition/Bylykbashi: Parliament to collect signatures

Democratic MP, Oerd Bylykbashi, declared today that collecting signatures consensually in the Assembly is the best solution in the race for Ombudsman.

During his speech in the Assembly, Bylybahsi stated that the European Union does not support the acceleration of the majority at this moment or political candidacies, and therefore they are willing to wait more time for the new name that will lead the institution.

"Let me clarify two things for you. The Rules of Procedure clearly state that it is not the candidates who run for office, but the deputies who propose. The Rules of Procedure give the deputy the right to withdraw from the draft law, from the draft decision, from the draft resolutions and from the candidacies at any moment. By analogy, I quote Article 72. The initiator of the draft law or draft decision, which can be a single deputy, can withdraw his project until it has been voted on in principle in the plenary session. Not only that, but based on the decision of the Laws Committee of November 17, which ultimately states very clearly that a deputy can only sign for one candidate, on November 5, the official withdrawal of all signatures and all proposals for all candidates was made. Which means, no candidate today has a legal position in front of this plenary hall.

What does this mean? It means that in accordance with Article 119, this withdrawal was made before the final assessment provided for in Article 111 of the regulation for candidates whether they have signatures or not. When on December 9, two days earlier, the Laws Commission reviewed the candidates, at that moment there were no longer any legal candidacies. All of them had withdrawn proposals, with withdrawn signatures. In the specific case, Endri Shabani was made clear on the day he received the signature that if he wanted to move forward using the opposition's signatures, but only the votes of the majority, his support would be withdrawn. So the request we made stands. I return to the process. I also warn you about something.

The European Union does not support your haste at this moment. It does not support political candidacies either. And therefore, they are willing to wait more time until this parliament collects signatures in a consensual manner, a consensual process with an ombudsman who stands up to that function in a manner worthy of that function. I remind you once again, the last two times, the ombudsman in 2010 has been a political compromise at the end of that, you remember the famous Crocodile dinner, when Prime Minister Berisha offered him with one condition.

With one and only one condition. It should not be a political persecutor, if it is someone else. You elected the ombudsman Totozani at the headquarters of the Socialist Party. In 2017, there was again a political agreement for the opposition to have him. So, it is a well-established tradition, which you confirmed at the end of the last session. I invite you to return to this process once again, otherwise, the ombudsman will be with a fundamental constitutional flaw, elected without an official proposal by the deputies and consequently, you would raise constitutional and legal questions about the future ombudsman. So, I invite you not to clash, it will not be recognized as compliance with the requirements of the European Union, I assure you of this. So it is better to do a process, find a way for us to gather, put signatures on the candidates and then start the voting process", - said Bylykbashi. /CNA
