The Specialist Chambers announced that they have released Haxhi Shala, Bashkim Smakaj, and Fadil Fazliu, under certain conditions.

Through separate announcements, the Specialist Chambers said that former Kosovo Liberation Army commander Haxhi Shala was released after the President of the Chambers, Ekaterina Trendafilova, modified his sentence.

"These conditions will continue to apply for the remaining three years of Shala's sentence," the Kosovo Specialist Chambers, also known as the Special Court, said in a statement, adding that Shala returned to Kosovo on February 10.

His family members have published photographs on social media showing Shala in Kosovo.

The modification of the decision comes after in December last year, the president of the Special Court, Ekaterina Trendafilova, had rejected Shala's request for a reduction in sentence.

According to the February 10 announcement, Trendafilova said that Shala has shown some signs of rehabilitation and had sent her a letter, "in which he expressed regret to all those who may have suffered harm as a result of his actions."

“The President ruled that, although the criminal offenses for which he was found guilty are serious, Shala had written the letter on his own initiative and without legal assistance, after a period of reflection. She found that his letter was a sign of sincere distancing from the criminal offenses for which he was found guilty,” the Special Court said.

According to the laws, when a person serves two-thirds of their sentence, they have the right to request that their sentence be reduced or modified "but only if they meet the criteria" for such a thing, the Special Prosecutor said.

Shala was sentenced to three years in prison in February 2025, after previously pleading guilty to obstruction of justice.

Shala had been in prison in The Hague since December 11, 2023. He was sentenced along with two others, Sabit Januzi and Ismet Bahtijari, against whom the prosecutors of the Special Court had an indictment for obstruction of justice.

Bahtijari and Januzi were each sentenced to two years in prison. All three had reached plea agreements with prosecutors.

What did the indictment say about Shala, Januzi and Bahtijari?

The indictment confirmed for the three defendants on July 10, 2023, stated that between April 5 and 12, 2023, Haxhi Shala, along with Sabit Januzi and Ismet Bahtijari, contacted a witness.

More specifically, according to the indictment, Ismet Bahtijari paid a visit to the witness at his home on April 5th, while Sabit Jonuzi paid a visit on April 12th.

The indictment also stated that the witness was asked to withdraw his testimony and offered benefits in exchange. The group crime, according to the Specialized Prosecution, was committed under the direction of Haxhi Shala.

The release of Smaka and Fazliu

Megjithëse Gjykatësi konstatoi se ende ekzistonte njëfarë rreziku që, në qoftë se lirohen, si Smakaj ashtu edhe Fazliumund të pengojnë ecurinë e procesit, ai arriti në përfundimin se e drejta themelore e tyre për liri peshon më shumë se këto rreziqe”, u tha në njoftim.

Gjykata tha se një arsye e lirimit të tyre është se nëse do llogaritej koha e kaluar në paraburgim e të dyve, atëherë kjo kohë tejkalon “dënimin minimal që do të merrnin sipas ligjit në qoftë se do të shpalleshin fajtorë”.

Gjykatësi mori parasysh gjithashtu se faza e paraqitjes së provave në çështjen gjyqësore Prokurori i Specializuar kundër Hashim Thaçit, Kadri Veselit, Rexhep Selimit, dhe Jakup Krasniqit tashmë ka përfunduar dhe se nuk ka gjasa që ndonjë veprim i mundshëm pengimi i tentuar nga z. Smakaj ose z. Fazliu të mos zbulohet”, u tha në njoftim.

Specialja tha se nuk ka rrezik që Fazliu dhe Smakaj të arratisen, pasi kanë ofruar dorëzani dhe do të humbnin këtë shumë financiare nëse do të arratiseshin.

Megjithatë, të dy mbeten të akuzuar për pengim të drejtësisë – gjykimi ndaj të cilëve do të nisë më vonë gjatë shkurtit – dhe lirimi është bërë nën një sërë kushtesh.

Për çfarë akuzohen Thaçi, Kilaj, Smakaj Fazliu dhe Kuçi?

Aktakuza e re kundër Thaçit dhe katër personave të tjerë, ish-ministrit të Drejtësisë, Hajredin Kuçi, ish-shefit të Agjencisë së Kosovës për Inteligjencë, Bashkim Smakaj, ish-kryetarit të Malishevës, Isni Kilaj, dhe Fadil Fazliut – u konfirmua më 29 nëntor, ndërsa u bë publike më 7 dhjetor.

Thaçi – i cili është duke u gjykuar nga kjo gjykatë në një rast të ndarë kundër ish-eprorëve të UÇK-së për krime lufte dhe krime kundër njerëzimit – akuzohet se bashkërendoi “tri grupe të veçanta” së bashku me Smakajn, Kilajn, Kuçin dhe Fazliun për të ndikuar në dëshmitë e dëshmitarëve të prokurorisë në rastin kundër tij dhe të tjerëve për krime lufte.
