Constitutional Court Decision/Zhupa: It was proven that the closure of TikTok

Democratic Party MP Ina Zhupa has reacted to the Constitutional Court's decision to close the TikTok platform.

In her post on social media, Zhupa states that the court's finding that the government's decision to shut down TikTok has violated freedom of expression is an important step in protecting democracy and fundamental rights.

Among other things, she adds that this decision confirms the position she had expressed earlier that closing the platform was a "serious act against freedom of expression and an action with a purely electoral motive."

The Constitutional Court's decision found that the interruption of access to the TikTok platform constitutes a restriction of freedom of expression and the press. I thank the Association of Journalists and the BIRN Investigative Network for independently submitting this to a constitutional trial.

The finding that the government's decision to shut down TikTok has violated freedom of expression is an important step in protecting democracy and fundamental rights.

This decision clearly confirms my position expressed earlier: closing a social network like TikTok, just because it could not be controlled by the government, was a serious act against freedom of expression and an action with a pure electoral motive.

The electoral campaign seems to have scared them so much that attempts were made to censor and restrict a platform where citizens express themselves freely and where propaganda cannot be controlled with "reports", "shadowbans" or propaganda applications.

Clearly a proven mechanism today that is used for electoral interests by silencing critical voices against the government and narrowing the space for political parties.

The Constitutional Court's decision is a strong reminder that freedom of expression cannot be violated by political decisions and that the fear of power has reached alarming levels. /CNA
