From "January 21" and electoral crimes to BKH operations/ Reports of the head of SPAK to parliamentary committees

Braho said that in 2025, criminal referrals from the police have been increasing, but more is expected from the police.

"During 2025, criminal referrals have increased in SPAK. And during 2026 we had referrals. We have great appreciation for the State Police. Any of them may have problems with the law, or we suspect that they may have.

We expect more from the State Police. The actions that the BKH can perform are procedural actions that the law allows the BKH. Obstacles may come due to the lack of operational infrastructure. We cannot replace the State Police, but the actions of the BKH without the police is a practice that we have seen in the homologous institutions with which we cooperate , "said Braho.

Present at the Laws Committee, where he reported on the annual activity of 2025, the head of SPAK, Klodjan Braho, was also asked about the issue of January 21.

Braho said that this matter is still under investigation and could not provide details.

The head of SPAK said that he understands the sensitivity of the case, but it is not an issue that can be resolved in a parliamentary committee.

Regarding the parties' claims, Braho said that they should turn to SPAK to receive the answers they require according to the Code.

" It is a matter under investigation and investigations continue. I understand the sensitivity of the case, but we cannot resolve it in this session. If the parties have claims, they should contact SPAK to receive an answer according to the Code ," said Braho.

Present at the hearing at the Electoral Reform Commission, SPAK leader Klodjan Braho was asked by MP Albana Vokshi about the issue of patronage activists and the reports made by the DP.  

Braho said that the issue of patronage is not within the competence of the Special Prosecution Office, this structure only has competence over corruption in elections.

Regarding the reports made by the DP, Braho stated that there was a reaction from SPAK for each of them and in April of this year the opposition was informed of every action.

" Patronage is not a competence of SPAK. SPAK has competence for active and passive corruption in elections. Regarding the reports filed by the DP, the prosecution has had a reaction for each of them. No later than April of this year, we have had a correspondence in which we have informed them of every action ," said Braho.

The head of SPAK said that the 2025 strategy was a first step towards moving towards a more structured and preventive model.

Braho announced that during the current year, 7 people have been convicted for the criminal offense of electoral crime. This, Braho said, shows that the crime continues after the election period.

Regarding the Task Force for the May 2025 elections, Braho said that SPAK, the CEC and the General Prosecutor's Office are finalizing the analysis report, which will then be forwarded to the Assembly.

Braho stated that regarding electoral crimes, SPAK aims for a more proactive approach and investigations that should also follow the money trail.

"Electoral crime appears with intensity during election periods. The experience of 2021-2024 served as the basis for a more structured approach in the 2025 elections. With the aim of not only reacting to reports. The 2025 strategy was a first step to move SPAK towards a more structured, more preventive model.

During 2026, 7 people were convicted of electoral crimes, which shows that the strategy continues after the election period.

The main type of punishment given by the court is imprisonment.

SPAK, CEC and the General Prosecutor's Office are in the final stages of completing the analysis for the 2025 elections and will ultimately be forwarded to the Assembly. The 2025 model works, but needs to be further refined by focusing on financial tracking. Electoral crime is not a matter for a single institution, it requires an integrated approach to prevention, investigation and criminal punishment.

"SPAK aims to have a more proactive approach in investigating electoral crimes, not focusing only on the election period. The investigation should also follow the money trail ," Braho said.
