Reports by the head of SPAK on corruption, organized crime and asset seizures

Kreu i SPAK, Klodjan Braho ka raportuar ditën e sotme për veprimtarinë e institucionit që ai drejton për vitin 2025 në Komisionin e Ligjeve.

Ndër të tjera, Braho foli dhe për raportet e sekuestrimit, ku tha se plani fillestar i SPAK është goditja e pasurive brenda hetimit penal.

Ndërsa si plan B, tha kreu i SPAK, është zbatimi i ligjit antimafia.

Kreu i SPAK tha se në këtë vit, janë kryer 4 konfiskime që e kalojnë në total shifrën 400 milionë euro, të gjitha të kryera breda hetiimt penal. Pavarëësisht këtyre statistikave, tha Braho, kjo nuk tregon që ligji anitmafia është i padobishëm.

Sa i përket vitit 2025, Braho tha se sipas Kodit Penal janë sekuesturar pasuri me vlerë 16 milionë euro si dhe janë konfiskuar pasuri me vlerë 1 milion euro.

“Përsa i përket raporteve të sekuestrimit, ne i zbatojmë të dyja mënyrat e sekuestrimit dhe të konfiskimit. Në sjelljen tonë dhe në objektivin tonë, plani A, plani i parë është goditja e pasurive brenda hetimit penal sepse ai është qëllimi kryesor. Zbatimi i ligjit antimafia është plani B, plani rezervë, atë që teoria e quan binar i dyfishtë. Por balancat mund të ndryshojnë në një vit të caktuar për shkak të peshës që mund të ketë një dosje e caktuar. Për shembull, në këtë vit ne kemi katër konfiskime që kalojnë në total rreth 400 milionë euro, mbi 400 milionë euro deri tani. Pra duhet të kujtojmë që buxheti i SPAK-ut është gjithsej 15 milionë euro në vit. Që janë të gjitha të kryera brenda hetimit penal. Po kjo nuk do të thotë që ligji antimafia është i padobishëm për ne. E kemi marrë në konsideratë edhe atë kontrollin post-legjislativ, ne kemi kthyer një përgjigje me shkrim dhe mendojmë që ka nevojë për përmirësime të vogla, por ky institut i sekuestrimit dhe konfiskimit të pasurive duhet të vazhdojë dhe është i domosdoshëm për shtetin dhe për organet e drejtësisë. Të sekuestruara për vitin 2025 sipas kodit të procedurës penale janë pasuri në vlerën rreth 16 milionë euro. Sipas ligjit antimafia janë 14 milionë euro. Të konfiskuara sipas kodit të procedurës penale janë 1 milion euro. Sipas ligjit antimafia janë 850 mijë euro. Por janë të përshkruara hollësisht në raport, në kapitullin përkatës që bën fjalë për sekuestrimit dhe konfiskimet, në faqen 50-55 të raportit vjetor”, tha Braho.

In his report to the Laws Committee on the activities of 2025, the head of SPAK, Klodjan Braho, focused on organized crime.

Braho said that referring to data from 2025, organized crime is appearing in more sophisticated forms.

The head of SPAK said that criminal groups are using clear division of roles and infiltrated communications, while adding that narcotics trafficking and laundering of the proceeds of crime remain among the main priorities of investigations.

Focusing on the risk profile, Braho stated that criminal groups constitute 54% of this category, narcotics trafficking 28.4% and laundering of the proceeds of crime 24.3%.

“ The 2025 data show that organized crime is emerging in more complex and sophisticated forms. Criminal groups no longer operate solely in the classic forms we have encountered before, but instead use clear separation of roles, infiltrated communications, fictitious business entities, formal transactions, and real estate investments. The 2025 investigations have shown that drug trafficking and laundering of the proceeds of crime remain top priorities.

In the risk profile, the structured criminal group constitutes 54% of this category, narcotics trafficking 28.4% and laundering of criminal proceeds 24.3%. In some cases, Albania is used as a transit, recruitment or laundering country for criminal proceeds. The main activity of the groups often extends outside the territory of Albania” , said Braho.

The head of SPAK, Klodjan Braho, in his report to the Laws Committee on the activity of the institution he heads for the year 2025, provided data for 2025.

Braho indicated that in 2025, there is an increase in the volume of investigations by 4.9%, with 219 cases completed.

The head of SPAK said that the institution he heads has an increasing workload, but without losing consistency in closing investigations.

Braho further focused on the appeals filed with the GJKKO, which he said have decreased significantly compared to the previous year.

So from 87 in 2024, to 32 recourses in 2025. Braho stated that regarding security measures, about 43% of them are related to corruption. The fight against corruption, said Braho, in 2025 marks an increase in investigative activity.

Something which, said the head of SPAK, is also reflected in the sending of 24 cases to court. The head of SPAK announced that in 2025, 16 senior officials were put under investigation.

" Increase in the volume of investigations by 4.9%. 216 cases have been completed. SPAK has an increasing workload without losing consistency in closing investigations. SPAK is increasingly relying on analysis, on financial investigations. The number of court decisions has increased from 72 to 76 decisions. The number of appeals filed with the GJKKO has decreased significantly, from 87 to 32. Regarding security measures, professional policy has been guided by the principle of proportionality. Of the measures applied, about 43% are related to corruption, while about 21% are related to organized crime. In the fight against corruption, 2025 marked an increase in investigative activity. This is reflected in the sending of 24 cases to court. 16 people, senior officials under investigation for 2025 ," said Braho.

SPAK leader Klodjan Braho said in today's hearing session at the Electoral Reform Commission that regarding electoral crimes, criminal prosecution operates at all times, not just during the election period.

Regarding decisions on these offenses, Braho said that they were made only in cases where the necessary evidence was provided.

Further, in his speech, Braho stated that regarding arrests, SPAK does not have the operational capacities to arrest wanted persons.

" What we are asking for is to make a difference. Criminal prosecution works all the time, not just during election periods."

The Head of the Special Anti-Corruption Structure, Klodjan Braho, was also asked about the OSCE/ODIHR report at today's hearing session at the Electoral Reform Commission.

Braho said that this report cannot be used in itself to prove a criminal fact. However, Braho said, this report is important for understanding the phenomenon of electoral crime.

Braho said that the investigation into any criminal offense must be complete, and electoral crime is no exception.
