Clashes over Vlora Airport / The concessionaire company reacts again

The concessionaire company Vlora International Airport (VIA) has made a clarification regarding the clashes with MABCO over the contract for Vlora airport.

In its response, the concessionaire company VIA stated that the issue is directly related to serious delays, non-fulfillment of the contract, non-commencement of some of the facilities foreseen in the contract, and actions that have jeopardized the normal progress of the project.

According to VIA, any declaration of investments of "hundreds of millions of euros" by the Contractor does not stand in relation to the contract and the actual works carried out on the ground.

VIA emphasizes that, even if all contracted works had been 100% completed, their value would have been around 62 million euros as stipulated in the contract and not hundreds of millions of euros.

Clarification of the concession company VIA:

Taking into account the incorrect statements publicly presented by MABCO Constructions SA - Foreign Company Branch, in the capacity of Contractor, the concessionaire company Vlora International Airport - VIA sh.pk clarifies the public opinion, institutions and media as follows:

The Vlora International Airport Company – VIA sh.pk, in the capacity of Employer, had a contract with MABCO Constructions – Foreign Company Branch, as Employee/Contractor, for the implementation of works on the buildings and relevant facilities of the Vlora International Airport, based on the Contract dated October 3, 2022 and Amendment No. 1, dated 20.02.2025.

The total value of this contract, for all the works that the Contractor was supposed to carry out until complete completion, was 62,071,030.85 euros including VAT.

For this reason, any declaration of investments of “hundreds of millions of euros” by the Contractor does not stand in relation to this contract and the actual works carried out on the ground. Even if all the contracted works had been 100% completed, their value would be around 62 million euros, not hundreds of millions of euros.

Of this contract value, works worth 24,085,241.35 euros have been certified so far, which constitutes 38.80% of the contract.

Even if we take into account not only the certified works, but also the works presented by the Contractor himself in the last situation submitted on February 5, 2026, which were not certified due to the lack of necessary documentation, the total value reaches 26,405,857.35 euros, or only 42.54% of the contract.

So, even according to the most favorable calculation for the Contractor, the works have not reached even half of the contract. This is the simple truth: the contract is about 62 million euros, while the certified work and the work presented but not certified only reach 42.54%.

Për shmangien e çdo keqinterpretimi, VIA sh.p.k. sqaron se të gjitha pagesat për punimet e realizuara dhe të certifikuara deri më tani janë paguar në tërësi ndaj shoqërisë MABCO Constructions – Degë e Shoqërisë së Huaj. Këto pagesa janë kryer ekskluzivisht nga financimi/kredia bankare që shoqëria koncesionare VIA sh.p.k. ka me Bankën Kombëtare Tregtare – BKT, sipas marrëdhënies përkatëse financiare të shoqërisë koncesionare.

Ndersa, shkëputja e kontratës nuk ka ndodhur papritur dhe as në mënyrë arbitrare. Ajo ka ardhur pas vonesave të konsiderueshme në realizimin e punimeve, mosfillimit të punimeve në katër godina të parapara me kontratë, ndryshimeve në projekt pa miratimin paraprak të VIA sh.p.k. dhe projektuesit, mosrespektimit të afateve kontraktore, si dhe dështimit për të korrigjuar shkeljet edhe pas njoftimeve formale të dërguara nga Punëdhënësi.

Përveç vonesave dhe shkeljeve kontraktore, Kontraktori ka penguar bashkëpunimin me organet mbikëqyrëse dhe përfaqësuesit teknikë të VIA sh.p.k., duke ushtruar presion, kërcënime, sjellje të papranueshme dhe sulme ndaj inxhinierëve/drejtuesve teknikë gjatë kryerjes së detyrës në kantier. Për më tepër, për njërin nga objektet me rëndësi jetike për certifikimin e aeroportit, Kontraktori ka vonuar qëllimisht dorëzimin dhe nuk ka paraqitur dokumentacionin e nevojshëm për pranimin e përkohshëm, me qëllim të vetëm pengimin e ecurisë së projektit dhe procesit të certifikimit.

Vetëm deri më 08.04.2026, janë evidentuar 429 ditë vonesë, me dëmvonesa të përllogaritura në shumën 4,290,000 euro, shumë e cila ka vijuar të akumulohet në përputhje me kontratën.

VIA sh.p.k., si shoqëri koncesionare, mban përgjegjësinë për menaxhimin e projektit, administrimin e kantierit, koordinimin e kontraktorëve dhe respektimin e afateve kontraktore e institucionale. Për këtë arsye, kur një kontraktor nuk përmbush detyrimet e tij, vonon punimet apo rrezikon ecurinë e projektit, VIA sh.p.k. ka jo vetëm të drejtën, por edhe detyrimin të ndërmarrë veprimet e nevojshme kontraktore dhe ligjore.

Përpara shkëputjes së kontratës, VIA sh.p.k. ka ndjekur procedurën kontraktore: ka dërguar njoftime formale për korrigjimin e shkeljeve, ka dhënë afate për përmbushje, ka konstatuar dështimin në korrigjim dhe më pas ka dërguar njoftimin për shkëputjen e kontratës. Megjithatë, edhe pas këtyre njoftimeve dhe mundësive të dhëna, Kontraktori nuk i ka përmbushur detyrimet në mënyrën, cilësinë dhe afatet e kërkuara nga kontrata.

Prandaj, çdo përpjekje për ta paraqitur këtë situatë si “bllokim aeroporti” është e pasaktë dhe keqinformuese. Kjo çështje lidhet drejtpërdrejt me vonesa të rënda, mospërmbushje kontraktore, mosfillim të një pjese të objekteve të parapara me kontratë dhe veprime që kanë rrezikuar ecurinë normale të projektit. Deklarimet mediatike, presioni publik apo tensionet në hyrje të kantierit nuk e ndryshojnë këtë fakt.

The concessionaire emphasizes that Vlora International Airport is a strategic national project and cannot be held hostage by delays, contractual non-fulfillment, public pressure or attempts to shift attention from real contractual responsibilities to the tensions created at the entrance to the construction site.

VIA sh.pk remains fully committed to continuing the works, maintaining safety on the site, protecting the public interest, respecting technical and legal standards, and completing the project in accordance with contractual and institutional obligations.
