New regulation enters into force/ Construction company licenses will be valid

Construction company licenses will have a validity period of up to 5 years, while individual licenses will be valid indefinitely.

The new regulation on professional licensing in the field of construction determines the validity periods of licenses for companies and individuals that carry out activities in the study, design, supervision and approval of construction works.

According to the new regulation published in the Official Gazette "On the approval of the regulation "On the criteria and procedures for granting professional licenses to individuals and legal entities in the field of construction study and design and supervision and approval of construction implementation works", professional licenses for companies that carry out construction study and design will be valid for a period equal to the term of the contract with the technical manager or managers, but in any case no more than 5 years.

For foreign entities, the validity of the license will be determined according to the term of the contract, when it is for a fixed term, but not more than 5 years. In cases where the contract does not have a specified term, the license will be valid for 5 years.

The same rules will also apply to professional licenses of companies that carry out activities in the supervision and approval of construction works.

Unlike companies, individual professional licenses will be granted for a permanent term.

The regulation also stipulates that the request for the addition of categories to a professional license may be submitted after a minimum period of 1 year has passed since the issuance of the license. This restriction does not apply when the addition of categories is a consequence of the change or addition of the company's technical managers, who meet the criteria set out in the regulation.

The regulation stipulates that the application for license renewal will be made through e-Albania.

Even for equipment with additions to the existing individual license, after the limitations and prerequisites specified in this regulation are met, the application will be made on the "e-Albania" portal and is accompanied by: a) an application on the unique government portal "eAlbania", where the categories that the individual requests to be added to the license that he or she has from a previous application are determined; b) the applicant's CV, where his or her activity performed from the previous application is reflected; c) the technical documentation justifying what is described as the activity performed in the CV, certificates from entities, institutions or organizations; projects (or parts thereof), where the person was a co-author; course or specialization certificates, related to the field in which he or she seeks to be licensed./Monitor
