Lied about arrest/ Fier Prosecution sends Lushnje Municipality official to trial

The Fier Prosecutor's Office has completed the investigations and sent a member of the Municipal Council to the Municipality of Lushnja for trial.

He faces charges of forging identity cards, passports or visas.

Specifically, he lied about his conviction and arrest. The Korça Prosecutor's Office in 2006 arrested him for exploitation of prostitution, for which he was sentenced to prison.

The Prosecutor's Office at the First Instance Court of General Jurisdiction of Fier has completed the investigations and is sending citizen AM, member of the Municipal Council, Lushnja, to trial for the criminal offense of "Forgery of identity cards, passports or visas", provided for by Article 190 of the Penal Code.

From the investigations into criminal proceedings no. 419, registered on the basis of the material sent for competence by the Special Prosecution Office against Corruption and Organized Crime, on 01.04.2025, it was proven that the defendant AM, ex officio member of the Lushnje Municipal Council, committed the criminal offense of "Forgery of seals, stamps or forms", provided for in Article 190/1 of the Criminal Code, as he presented incorrect (false) data, which do not reflect the truth and do not correspond to reality in the Self-Declaration Form "On the implementation of Law no. 138/2015 "On guaranteeing the integrity of persons elected, appointed or exercising public functions", deposited with the Election Commission of the Elections on 23.03.2023.

Specifically, in the aforementioned form, completed and signed by the defendant AM, it results that on page 4, in the column numbered "4" where it is asked: "Have you ever been detained or arrested by law enforcement agencies for committing a criminal offense?", citizen AM has marked "No". Also, in the column numbered "5" where it is asked: "Have you ever been imposed a personal security measure, in force or not?", citizen AM has marked "No".

Meanwhile, during the investigation, it turns out that the opposite has been proven, that is, that citizen AM has been detained and the security measure "Arrest in prison" has been imposed on him, provided for by article 238 of the Code of Criminal Procedure, where he has remained in pre-trial detention for a period of 5 months. Specifically, the Prosecutor's Office of the Korça Judicial District on 15.02.2006 detained citizen AM, suspected of committing the criminal offense "Exploitation of prostitution", under aggravating circumstances, provided for by article 114/a/5 of the Code of Criminal Procedure. Detention which was validated as lawful by the Court of the Korça Judicial District with decision no. 42 Regj., dated 19.02.2006, imposing on citizen AM the security measure "Arrest in prison" without a term, provided for by article 238 of the Code of Criminal Procedure.
