The Rome Court of Appeal has raised doubts about the legality of the detention of three migrants at the reception center in Gjadra, also questioning the legitimacy of the protocol signed between Italy and Albania for the reception of migrants.

Italian media  write that the case concerns three Moroccan citizens, who had previously received deportation orders from Italy and had criminal convictions. 

According to the court, the request to confirm the detention of the three migrants could not be approved, as there are doubts about the legitimacy of the Italy-Albania protocol and the subsequent law ratifying it.

However, the judges noted that from a review of the documents, including the deportation order and documents transmitted by the Police Headquarters, it does not appear that there was a previous asylum application and that it was rejected, even though the prosecutor stated otherwise at the hearing, but was unable to document the allegations in each case. 

They also raised concerns about the compatibility of the detention of asylum seekers in Albanian centers with European Union directives, according to which persons seeking international protection have the right to remain in a member state until a decision is made on their application.

The court's decision adds to the debates about the implementation of the Italy-Albania agreement on the treatment of migrants arriving on Italian territory. /CNA
