Safety expert, Gert Metani, shared some explanations based on the criminal provision regarding the tragic accident that occurred yesterday in Durrës, where two children lost their lives.
Invited to A2 CNN, Metani stated that in accidents with consequences, which in this case also have the aggravating circumstance of driving under the influence of alcohol, based on the Criminal Code, the perpetrator can receive a prison sentence of 10 years.
"The criminal provision is like this: accident with consequences, from one to five years, and then if there are aggravating circumstances such as alcohol consumption, wrong maneuvers, it goes up to 10 years. And if there are mitigating factors that the person has provided first aid, a request for forgiveness, repentance, reflection on what he has done. I am not a judge and normally all cases will be analyzed, but based on the Criminal Code, the provisions in force, the circumstances that we know for now, the average is 10 years," said Metani. /CNA
