The head of SPAK, Klodjan Braho, during his report to the Committee on Civic Initiatives, was asked about the Constitutional Court's decision on seizures.

According to Braho, the Constitutional Court's decision has brought about a change in judicial practice in the prosecution and courts, emphasizing that there is a lack of procedural regulation.

Braho said that there are different practices on some elements that such an issue cannot be regulated with a decision of the Constitutional Court.

He underlined that the Constitutional Court recognizes the principle but states that there is a need for a procedural legal regulation for the procedure, deadlines, and manner, and according to him, it is an immediate need.

Braho emphasizes that the best way would be to reformulate the relevant provision.

"Regarding the Constitutional Court's decision, it has brought about a change in judicial practice in the prosecution and courts. There is a lack of procedural regulation. The Court and Prosecutors implement the Constitutional Court's decision. There are different practices on some elements that such an issue cannot be regulated with a decision of the Constitutional Court. The Constitutional Court recognizes the principle, but I think there is a need for a procedural legal regulation for the procedure, for the deadlines, the method, and I think it is an immediate need. It has not harmed the investigation, we have implemented it, but there are different practices within the court. These are requests related to the preliminary investigation phase and the Supreme Court is far from having a procedure that can carry out a reconciliation. However, the best way would be to reformulate the relevant provision," said Braho./ CNA
