SPAK requests the termination of criminal proceedings against Irena Gjoka

The Special Prosecution Office has requested a stay of criminal proceedings against Judge Irena Gjoka for the criminal offense of "Forgery of seals, stamps or forms".

This proceeding was registered based on the complaint filed by Adriana Kalaja, in her capacity as the chairwoman of the Appeal and Statute Evaluation Committee of the Democratic Party.

The SPAK announcement states that a trial was held in absentia against Judge Irena Gjoka in Greece, where she was found guilty and sentenced for using irregular documents.

It is further stated that in this context, there is no documentation proving that she was actually and effectively notified of either the conduct of the trial or the announcement of the decision.

Among other things, it is added that from the official verifications carried out, it results that the criminal records issued by the Greek authorities do not contain any information about a criminal conviction against her, while in the self-declaration form she has also declared that she has not been convicted by a final decision.

SPAK states in the announcement that even if the existence of this criminal decision were taken for granted, the criminal prosecution regarding this fact results in being extinguished due to the statute of limitations, in accordance with the relevant applicable legislation.

The Special Prosecution Office against Corruption and Organized Crime has filed with the Special Court of First Instance the request for termination of criminal proceedings no. 130 of 2025 against the complainant Irena Gjoka, registered on 5.6.2025, for the criminal offense of "Forgery of seals, stamps or forms", provided for by Article 190 of the Criminal Code.

This criminal proceeding was registered based on the complaint filed by citizen Adriana Kalaja, in her capacity as the chairwoman of the Appeal and Statute Evaluation Commission of the Democratic Party. The complaint material was filed with the Special Prosecutor's Office on 20.5.2025 and included falsification of documents, abuse of office and exercising illegal influence.

Within the framework of this proceeding, additional reports, reference materials and documentation from various institutions have been administered, and numerous investigative actions have been carried out, including verifications at the General Prosecutor's Office, the Ministry of Justice and foreign authorities, through international legal cooperation mechanisms.

Nga aktet e administruara, përfshirë dokumentacionin e përcjellë nga autoritetet e drejtësisë së Republikës së Greqisë, evidentohet se ndaj shtetases Irena Gjoka (alias Shpata; Maneku) ekziston një vendim gjyqësor penal i Gjykatës së Shkallës së Parë Janinë, me nr. 1447/2005, përmes të cilit ajo është deklaruar fajtore për veprën penale të parashikuar nga legjislacioni penal grek “Hyrja dhe qëndrimi i të huajve në Territorin Grek”, e dënuar me burgim dhe gjobë (konvertuar në gjobë sipas dispozitivit të vendimit).

Materialet e administruara tregojnë se Irena Gjoka ka qenë subjekt i procedurave administrative dhe gjyqësore në Greqi, pas dy episodeve në kufi, ku është konstatuar përdorimi i dokumenteve të parregullta dhe tentativa për hyrje me të dhëna të ndryshme identifikuese. Si pasojë, ndaj saj janë marrë masa administrative, përfshirë dëbimin dhe ndalimin e hyrjes në zonën Schengen, të cilat janë kundërshtuar prej saj në gjykatat administrative greke.

Në vijim, nga dokumentacioni i siguruar rezulton se ndaj saj është zhvilluar edhe një proces penal në Greqi, konkretisht me vendimin nr. 1447/2005 të Gjykatës Penale të Shkallës së Parë në Janinë, ku ajo është shpallur fajtore dhe është dënuar për përdorim dokumentesh të parregullta. Megjithatë, ky gjykim është zhvilluar në mungesë të saj, ndërsa njoftimi është realizuar sipas procedurave për persona me vendbanim të panjohur. Në këtë kuadër, nuk rezulton të ketë dokumentacion që provon se ajo është njoftuar realisht dhe në mënyrë efektive as për zhvillimin e gjykimit dhe as për shpalljen e vendimit.

Gjithashtu, nuk rezulton të jetë administruar dokumentacion që provon njoftimin e vendimit gjyqësor ndaj saj, si dhe nuk evidentohet marrja dijeni në mënyrë efektive për ekzistencën e këtij vendimi në kohën e dhënies së tij.

Autoritetet greke, në vijim të zbatimit të legjislacionit përkatës (ligji nr. 3346/2005), kanë urdhëruar mosekzekutimin dhe arkivimin e vendimit penal, për shkak se ai nuk kishte marrë formë të prerë dhe për shkak të parashkrimit të veprës penale.

Po ashtu, nga verifikimet zyrtare të kryera rezulton se në dëshmitë e penalitetit të lëshuara nga autoritetet greke nuk figurojnë të dhëna për dënim penal ndaj saj, ndërkohë që edhe në formularin e vetëdeklarimit ajo ka deklaruar se nuk është dënuar me vendim të formës së prerë.

Nga analiza e mëtejshme e akteve rezulton se edhe sikur të merrej e mirëqenë ekzistenca e këtij vendimi penal, ndjekja penale lidhur me këtë fakt rezulton e shuar për shkak të parashkrimit, në përputhje me legjislacionin përkatës të aplikueshëm.

Duke marrë në konsideratë mungesën e njoftimit të rregullt, zhvillimin e gjykimit në mungesë, si dhe kalimin e afateve ligjore të ndjekjes penale, konstatohet se nuk ekzistojnë kushtet ligjore për vijimin e mëtejshëm të ndjekjes penale për këtë çështje dhe se nuk provohet që magjistratja Irena Gjoka të ketë kryer veprën penale.

Under these conditions, the Special Prosecution Office against Corruption and Organized Crime has requested the dismissal of the case, based on articles 28/1, 75/a and 328 point 1, letters "d" and "dh", as well as 329, letter "a" of the Code of Criminal Procedure.

This request has been submitted to the Special Court of First Instance for Corruption and Organized Crime.
