The state must pay 180 million euros for international arbitrations

Liabilities related to international arbitration decisions and legal proceedings against the Albanian state amounted to around 179.6 million euros at the end of 2025.

At least that's what the Ministry of Finance confirms in the actual budget. Almost the same level of liabilities was reported in the actual budget for 2024, not showing any progress in the processes in which the state is involved. Of the total of 179.6 million euros, 69.8 million euros represent outstanding liabilities from arbitration decisions and legal costs, while 109.8 million euros are contingent liabilities.

The largest weight of the exposure is related to the ICSID Arbitration case ARB/5/28 “Hydro and others against Albania” where the state is facing Italian entrepreneur Francesco Becchetti. The Finance Report shows a contingent liability of 108.3 million euros, with no payments made during the year. This is the largest item in the table published by the Ministry of Finance with approximately 60 percent of the total.

Another case with considerable exposure is the ICC arbitration Case No. 23998/MHM (Copri-Aktor v. ARRSH), for which the outstanding liability is 41.1 million euros. The conflict with the Albanian state is related to the Tirana-Elbasan road.

The report also includes the ICC arbitration Case No. 25414/HHM Constructioni Dondi SPA, where the outstanding liability is estimated at 13.3 million euros. The company, together with the Japanese company Kubota, carried out the improvement of the Tirana sewage system (Kashari area) in 2014, but the termination of the contract ended in a legal dispute.

Another case is ICC Case No. 22676/GR GBC Oil Company LTD against MIE, AKBN and Albpetrol, with a remaining liability of 11.9 million euros.

PAYMENTS

The data shows that during 2025, payments were made for a portion of the court proceedings and legal costs. During 2025, the Albanian state paid around 1.47 million euros for obligations related to international arbitrations and their costs. In total, payments made over the years for these matters amount to 11.43 million euros, while the remaining and contingent liabilities continue to be calculated at around 179.6 million euros.

In some processes, administrative costs or legal fees have been fully paid, while in others, obligations still remain that will depend on the progress of court proceedings or the execution of final decisions.

The report explains that the liabilities presented do not have the same legal nature. According to the accompanying notes, some represent final arbitration decisions, some relate to contracts for legal services and expertise, while contingent liabilities represent issues that are still under review and may materialize only after final decisions of international courts or tribunals. Contingent liabilities do not constitute payable liabilities at the time of reporting, but reflect the potential exposure of public finances to ongoing international processes./ Monitor
