Accused of corruption, the lawyer tells how many years in prison Berisha risks:Former prosecutor Eugen Beci was invited to MCN TV, where he spoke about the ongoing process against Sali Berisha, who today is officially indicted by SPAK and accused of passive corruption committed in collaboration. 

Beci said that Berisha risks from 4 to 12 years of imprisonment, if he is found guilty, but added that even the punishment is a complex process that takes into account many factors. 

"The offense is provided for by Article 260 of the Criminal Code, a special form of cooperation. It is punishable by 4-12 years of imprisonment.

It is an act of notification of the charge which means the fact that the prosecution, at the first moment, took Berisha as a person under investigation and therefore, based on the evidence it had, qualified him as a person against whom it conducts investigations. The suspicion of the special prosecutor's office on criminal offenses was made official yesterday.

The Special Prosecutor's Office, in a year of investigations, has advanced by announcing a written act of accusation, which is officially called a defendant.

Passive corruption committed in cooperation is the presence of a legal violation, with the purpose of benefiting from goods and material income, or other form of benefit that comes due to the duty, by performing illegal actions, intentionally, that have brought benefits to someone else, in this case also for the former prime minister.

In case you violated the law and benefited from money, it must be proven that you did it intentionally and with other people who advanced by giving you material goods.

The Special Prosecutor's Office should tell the former prime minister whether you committed an illegal violation and then prove who influenced this violation," said Beci. 

Asked by journalist Ylli Rakipi, whether it will be possible for Berisha to be released from house arrest until the end of the process, Beci said that it is theoretically possible. 

"Theoretically yes, but practically it has turned out that up to the stage we are in, what Berisha's lawyers have done has not been taken into consideration.

Regarding the destruction of the evidence, there is no longer any reason to think that it could be damaged," said the lawyer.
