Lulzim Basha towards dismissal/ Why even Gazment Bardhi can’t save him

Two days ago, during his speech in ?Rostrum? with the Democrats in Lezha, the Prime Minister and the historical leader of the Democrats, Sali Berisha, announced the date when will convene the National Assembly of the Democratic Party, for the dismissal of the incumbent leader, Lulzim Basha.

The statute of the Democratic Party states that one of the central decision-making bodies is the National Assembly. Article 43, point 3, states, among other things, that the National Assembly has the right to dismiss the chairman.

?The National Assembly has the competence to:a) approval of the DP Statute and its amendment; b) the approval of the party program and the main lines of its policy, which are the basis of work for the elected DP at the central and local level, as well as for the executive power led by it; c) election of members of the National Council; ç) the dismissal of the chairman of the party on the basis of a motion of no confidence approved by more than half of all members of the National Council ?– states the statute.

But what happens in the case of Basha?s dismissal? Article 46, point 4 states that in the absence of the chairman, the Secretary General convenes the National Council, which commands the deputy chairman of the DP, who will lead the party until the return of the chairman to office or the election of a new chairman.

?During his daily activity, the chairman of the party assigns certain tasks and areas of responsibility to the vice-chairmen of the party. In the extended absence of the chairman and with his authorization, one of them replaces the chairman.

In the absence of this authorization, including cases of resignation of the chairman, the Secretary General convenes the National Council, which commands the deputy chairman who will lead the party until the return of the chairman or the election of a new chairman?-

it said in the article 46, point 4, of the DP statute. So, in this case, it is claimed that the ?salvation? for Lulzim Basha will be Gazment Bardhi. But the pear has its tail back. Legally, the Democratic Party doesn?t have a General Secretary, due to the fact that Bardhi was not elected by secret ballot. Gazment Bardhi has been appointed General Secretary by Lulzim Basha.

There was not neither secret ballot nor an alternative candidacy. At the meeting of the National Council of the Democratic Party, at the end of August, were elected the new leaders, vice-chairman, secretariats and the new Presidency of this political force.

One detail that was noticed is that in fact Lulzim Basha didn?t allow a race in the DP, but simply reconfirmed his appointees, both the vice-chairman and the General Secretary of the Party. But Article 44, point 6 of the Statute of the Democratic Party, clearly states that it is the National Council, which decides by secret ballot the appointment or dismissal of the Secretary General.

?The National Council exercises the following responsibilities or rights: a) decides, by secret ballot, on the appointment and dismissal of the Secretary General; party vice chairman; elected members of the DP Presidency; functional secretaries; chairman and members of the Appeals, Integrity and Ethics Committee; the chairman and members of the Election Commission, as well as to the chairman and members of the Financial Board of the Party?-it is stated in the statute of Democratic Party.

So, in legal terms it turns out that the Democratic Party doesn?t have a General Secretary and even Gazment Bardhi can not save the ?stamp? that Lulzim Basha holds in his pocket. He holds his office in violation of the statute and is not legally the General Secretary of the DP. So, his decisions are not legal and have no executive power in the DP, as the statute requires him elected by vote and not appointed by Lulzim Basha./CNA.al
