What is the vetting requested by Lulzim Basha?/ A brief explanation

For 2 days, has been launched in the political market the idea of ??a vetting for politicians, which Lulzim Basha is proposing as a political innovation, as a new idea, when in fact it is a variant often mentioned since the time of the protests in the Tent in 2017.

So we have more of a return to the theses of the new Republic, than new political ideas of Lulzim Basha. But what is this vetting presented in just a few sentences? First, according to what Lulzim Basha proposes, vetting is an administrative concept.

So, to investigate the assets and statements made by politicians. In fact, SPAK, for which Basha wants to carry out this process, is a criminal investigation body. So there is no possibility for a criminal investigation body to conduct an administrative investigation.

This is clearly defined by law. Administrative investigations are carried out by the High Inspectorate of Declaration and Control of Assets and Conflict of Interest, which is the institution that currently exists in Albania and deals with the declaration of assets.

If Basha doesn?t like this institution, he can dissolve it, or he can make it part of the General Prosecutor?s Office. But the request made is wrong. Because when the Inspectorate or the prosecution has itself suspicions of hiding property from certain persons in politics, denounced in the media or other ways, then begins the investigation.

And this issue is being investigated by SPAK. It is then up to the court to impose the sentence. It may be incompetence or ignorance to give the SPAK the powers of administrative investigation. And what is worse, in the way formulated by Lulzim Basha and the people around, it is clear that the SPAK wants to be made both a criminal investigative body and an administrative investigative body.

But this is completely inappropriate. An idiocy that makes even a novice lawyer laugh. Without further ado, this is totally out of the nature of SPAK and contradicts the provisions that define the field of activity of this institution.

In short, what Lulzim Basha is looking for is simply to find a cause in front of Sali Berisha?s ?Rostrum? and attract the attention of public opinion. This kind of vetting that Basha demands, in this kind of form, and in this kind of way, has no legal and constitutional space to be done.

But Lulzim Basha is throwing it on the market for a reason. To say ?It was me who asked for the vetting, while Edi Rama doesn?t want it. Even those who criticize me in the DP are against this vetting. Albanians love this kind of vetting!?.

But the proposal made is not legal. It doesn?t have a clear legal form. It is a deliberate chaos, as we mentioned above, for Basha to find space to play with public opinion against ?Rostrum?. To find any possible space to hit Sali Berisha. Or to have the opportunity to articulate in public that he loves the vetting and purity of politicians.

When in fact everything closes with one sentence. In case the vetting of politicians takes place, the first to leave from politics is Lulzim Basha. Therefore, he didn?t make the proposal accurate, clear, so that there is no vetting of politicians, but only empty public debates, to attract the attention of public opinion for a few days./CNA.al
