Taxes begin construction control/ Companies notified of salary and sales

Announced in October, the Tax Administration has launched the Operational Plan for the construction sector, with the aim of monitoring and controlling financial practices in this sector.

Initially, the Tax Administration has sent notices to construction companies, as part of an information campaign that will last 30 days. In January, after the end of the 30-day information phase, inspections will begin for entities that have not responded to the tax administration's calls.

Businesses have been notified through the e-Filing system about the launch of this process. In the notification sent, the Tax Administration asks taxpayers to carefully fulfill their legal obligations, including declaring employees, salaries, transactions and using certified fiscalization software.

The tax administration has data about you, obtained from the APT, the governing bodies

The Tax Administration encourages you to fulfill your obligation regarding:

Declaration of each employee employed;

Real declaration of salaries based on profession and labor market;

For each sale/transaction carried out by you, issuing fiscalized invoices;

Purchase of any goods/services with a regular tax invoice;

Accurate declaration of data in the Taxpayer register;

Accurate declaration of premises rental contracts;

"Use only certified fiscal software," states the tax administration's notice sent to businesses.

But accountants and representatives of construction companies raise concerns that notices from the Tax Administration, such as this one for the construction sector, often have a warning tone even though they do not contain direct accusations of tax evasion or legal violations. They claim that these notices are creating pressure and stress on regular businesses.

Meanwhile, the Director General of Taxes, Ilir Binaj, stated a few days ago in a meeting with member companies of the American Chamber of Commerce that after the end of the 30-day information phase, inspections will begin in January for entities that have not responded to calls from the tax administration.

According to him, during this phase, businesses will be clearly informed about the administration's requirements, while controls will focus on sales prices, salary declarations, and current activity.

“In relation to our harmonisation efforts, we will start in January with the construction sector. Our approach will be similar to what we have had before: we will start with a 30-day information phase, clarifying what we are looking for. During this phase, we will send a large number of notifications to inform and educate taxpayers identified by the risk analysis. For businesses that do not respond to our calls, controls will be initiated, focusing on current activity such as sales prices, wage declarations, etc.

As part of the implementation of the sectoral plan for construction and the increase in social security contributions, the Tax Administration previously announced that it will analyze the declared salaries of employees in this sector. The analysis will be based on comparing declared salaries with indicative salaries according to construction professions, in order to assess the risk of unrealistic declarations.

Initially, the tax authorities announced that the operational plan for controlling the construction sector would begin in October. /Monitor
