The company "Encyclopedic Publications" of Ajola and Valbona Xoxa privatized the flowerbed and the sidewalk

A mountain of documents for a flagrant case, in the name of the company "Botime Enciklopedike", where the main shareholders are Ajola Xoxa and her mother Valbona Xoxa, have registered as property an area that was previously a flowerbed and has now been turned into a sidewalk.

According to the complaint received by CNA, this was done in violation of the law by ASHK, playing with the relevant surfaces, documents and sketches and without assessing the situation on the ground.

Actions have been taken to divide ownership, but essentially what appears to be there even in old photos today, a flower garden that served several businesses, has been turned into private property, perhaps with the intention of tomorrow that the building will be demolished and the next tower will be built.

The company "Encyclopedic Publications", according to data provided to the Central Library, had as administrator Ajola Xoxa, the wife of Mayor Erion Veliaj, who is in Durrës prison with 13 serious criminal charges filed by SPAK.

Today, the company has as administrator Valbona Xoxa, Ajola's mother, who is also the chairwoman of the Supervisory Council, where Erald Simixhiu is also a member. The latter is the key figure in many of Ajola Xoxa's movements, both in contracts and actions for partnerships with incinerator companies, as well as in "Botime Enciklopedike", another entity of Ajola and her mother, which, according to some documents, also owns a flower garden converted into land.

According to documents provided by CNA, the actions have gone through several steps to lead to the registration of property no. 5/360, Cadastral Zone 8210, with an area of ??415.88 m², in the name of “Encyclopedic Publications” Sh.A.

Everything has to do with verifying the legality of the procedure followed by ASHK/ZVRPP Tirana, where there are allegations that by using sketches and playing with documents, it was possible for the sidewalk and the flowerbed to become private property and not state property.

The area of ??the flowerbed and sidewalk on “Muhamet Gjollesha” street in Tirana, which was transferred on January 28, 2016 to the ownership of “Botimeve Enciklopedike” Sh.A. is 415.88 m². Whoever walks there on the sidewalk, but also in the bicycle lane, passes through the property of Ajola Xoxa. The husband is the mayor, the wife is the owner of the sidewalk where citizens walk.

ASHK/ZVRPP Tirana, in order to transfer the 415.88 m² area to the ownership of "Botimeve Enciklopedike" Sh.A., first issued the order for the division of property 5/171.

According to the order, property 5/171 with an area of ??465.88 m² is divided into:

- Property 5/360 with an area of ??415.88 m² in the name of "Encyclopedic Publications" Sh.A.

- Property 5/361 with a surface area of ??50 m² in state ownership.

The order states that the division was made "based on the privatization outline."

Looking at the mortgage certificate from 2007, the document identifies the historical property of "Encyclopedic Publications", but does not clearly present the origin of the 415.88 m² area, its concrete boundaries, or the document of acquisition of this area.

This is because, according to the 1995 plan, there are green areas (flower beds) near the "Encyclopedic Publications" building. How can the flower bed be privatized?! CNA was also able to obtain an old photo showing the flower bed, which was later demolished and turned into a sidewalk.

The document indicates the existence of a historic flower garden, but it is not clear that this plan identifies the entire area of ??415.88 m² registered in 2016, owned by "Botimeve Enciklopedike" Sh.A.

The analyzed documentation reveals several issues that remain doubtful, but also require in-depth verification of what happened to the flowerbed and the sidewalk and how they ended up in the ownership of "Encyclopedic Publications" Sh.A.

Firstly, the technical document on which the area of ??415.88 m² is determined is not clear from the available materials.

Secondly, the 1995 historical plan and the CNA photo show a flowerbed, but even this document does not clearly define the boundaries of the property registered by “Botimet Enciklopedike” Sh.A. in 2016.

Thirdly , the ASHK, to which we have officially addressed, must verify whether the registered area corresponds only to the historical garden or includes other areas.

IN THE FIELD

From the video recorded on Friday on “Muharrem Gjollesha” street, dated June 19, it turns out that the surface that we are reporting and have brought part of the documentation is paved and used as a passage area, i.e. sidewalk, there is also a bicycle lane. So citizens are now walking on the property of “Botimeve Enciklopedike” Sh.A. Tomorrow it is not known what will happen to the building and the land, it is in one of the most attractive areas for construction.

The surface is clearly functionally connected to the entrances to the units on the ground floor of the building, all of which appear to be non-functional.

The video proves the current condition of the property, but not by itself the legal status of the property, which is owned by "Botimeve Enciklopedike" Sh.A. (continued)/ CNA
