QKB, how private companies are being favored through the "free"

An agreement between the National Business Center (NBC) and the Institute of Fiscal Experts (IEF) has raised concerns about competition in the fiscalization and accounting market. The agreement foresees the distribution of the SmartFin platform free of charge to businesses, an initiative that on the surface seems like assistance, but which has raised suspicions of favoring a private company with institutional support.

UNFAIR ADVANTAGE FOR A PRIVATE COMPANY

CNA reported that offering the platform for free could create an unfair advantage for SmartFin, undermining licensed private operators that offer similar paid services. The Law on Protection of Competition prohibits any intervention by public institutions that favors one entity over others, and CNA requested information from the CNB on the legal basis of the agreement and its impact on the market.

Without transparency and without equal criteria, a platform supported by the NCC risks favoring a single actor, not because of performance or innovation, but because of institutional support.

BUSINESS CONFUSION

Following initial reporting, CNA secured conversations between new businesses, SmartFin and IEF, which illustrate the unclear situation the initiative has created. Representatives from SmartFin and IEF provide different explanations for the nature of the collaboration and the free application period.

 

SmartFin explained that the platform is free until January 2026, but it is not known what will happen after that date. The company also has direct access to the basic business registration data from the Central Bank, giving SmartFin a competitive advantage.

Even IEF itself does not have complete information about the pricing or business model, adding to the confusion among businesses. Many of them perceive the platform as a free state service, even though it is in fact a private solution distributed with institutional support. This situation has caused uncertainty and concern about the impact on free competition.

CNB'S REACTION TO CNA

After CNA's questions, the Central Bank of Kosovo responded by stating that the cooperation with IEF is in accordance with the law and does not violate competition. The institution emphasizes that the agreement does not contain exclusivity and is not binding on commercial entities, while it aims to improve financial reporting and technological development of businesses.

Sipas QKB-së, propozimi për memorandum ka ardhur nga vetë IEF, e cila ka kërkuar ofrimin falas të programit SmartFin dhe marrëveshja nuk parashikon asnjë përfitim financiar për QKB ose IEF. Megjithatë, institucionit i mungon një sqarim i qartë mbi arsyen e përzgjedhjes së SmartFin, nëse është kryer vlerësim i ndikimit në treg dhe nëse janë konsultuar operatorët e tjerë privatë të licencuar.

Reagimi i QKB-së justifikon ligjshmërinë e bashkëpunimit dhe përfitimet për bizneset, por nuk heq shqetësimet për favorizim të një kompanie private dhe mungesë transparence.

KONFUZIONI DHE PASIGURIA NË TREG

Në praktikë, bashkëpunimi publik-privat ka krijuar perceptimin se një kompani private po ofron shërbime falas me mbështetje institucionale. Bizneset ndihen të pasigurta mbi natyrën e shërbimit dhe mbi atë se kush qëndron realisht pas platformës. Avantazhi i SmartFin në këtë kontekst mund të shtrembërojë konkurrencën e lirë dhe të vendosë një aktor privat në pozicion të privilegjuar ndaj konkurrentëve të tjerë që ofrojnë shërbime me pagesë.

Denoncimet e CNA-së, bisedat me bizneset dhe reagimi i QKB-së tregojnë një panoramë komplekse, një iniciativë që synon ndihmën për bizneset ka krijuar konfuzion dhe dyshime për favorizim të një kompanie private. Ndërkohë që mungesa e transparencës dhe e kritereve të qarta për përzgjedhjen e SmartFin lë vend për shqetësime mbi barazinë në treg dhe konkurrencën e lirë.

Iniciativat teknologjike dhe falas janë të dobishme, por mbështetja e një aktori privat nga institucioni publik kërkon kritere të qarta dhe transparencë për të shmangur privilegje të padrejta dhe për të ruajtur besueshmërinë e tregut./CNA
