Judges' salaries/ "Constitutional" gives deadline to the Assembly

The Constitutional Court has published the full reasoning for the decision on judges' salaries, leaving the Albanian Parliament a clear deadline to intervene with legal changes.

The decision, taken on February 17 by a majority vote, partially accepts the judges' request and emphasizes that their salaries cannot be reduced, either directly or indirectly. However, the specific manner of regulation is delegated to the Assembly.

According to the Constitution, lawmakers must adopt by July 31, 2026, a new formula that guarantees the maintenance of salary levels and avoids any “hidden cuts.” This formula could be linked to changes in public administration salaries, the level of the President’s salary, or other comparable economic indicators.

The court underlines that the regulation must respect the constitutional principles of judicial independence, but at the same time take into account factors such as inflation and economic developments, which affect all categories of employees equally.

"The Assembly may choose to adapt the new formula in order to repair the hidden reduction either by referring to the change that the category of civil servants to which the old formula referred or to the change that the President's salary underwent, or any other solution comparable to the changes in the above categories and within their limits, always respecting the guarantees of Article 138 of the Constitution, bearing in mind the fact that inflation and the economic situation have the same effect on all categories of employees, regardless of the duty and function they perform," the Constitutional Court's decision states.

The issue was raised by two judges' associations, which demanded that salaries be automatically indexed in line with increases in other state sectors, considering this as a guarantee for the independent functioning of the justice system./ CNA
