The Berat Court, at the request of the Prosecutor's Office, has found four citizens guilty and sentenced them to prison for distributing narcotics in a nightclub. According to the Prosecutor's Office, the convicted are the owner, bodyguard, manager and waiter of the nightclub where cocaine was being sold.

The investigations, it is reported, began after information was received that the owner of the EV bar was involved in the distribution of cocaine in the city of Dimal and beyond. This citizen kept the cocaine hidden in one of the blocks of the surrounding wall of his bar and divided into small doses. One dose was sold for 2000-5000 lekë.

After taking their dose of cocaine, the customers consumed it in the restrooms of the bar, while in this activity he was also assisted by the bar's bodyguard KD, manager KI and waiter RZ. The bar owner was sentenced to 8 years in prison, while the bodyguard, manager and waiter were each sentenced to 4 years and 8 months in prison.

PROSECUTOR'S NOTICE:

They distributed cocaine in a nightclub under the nickname 'amaro'. At the request of the Berat Prosecution Office, the owner, bodyguard, manager and waiter were sentenced.

At the request of the Prosecutor's Office at the First Instance Court of General Jurisdiction in Berat, four citizens, EV, KI, KD and RI, were found guilty and sentenced for the criminal offense of 'Production and sale of narcotics' committed in collaboration, as provided for in Article 283/2 of the Criminal Code.

At the conclusion of the investigation and trial of criminal proceeding No. 319 of 2023, it was assessed that the charges brought against the defendants are fully proven.

The investigations started from information from the Crime Investigation Section, at the Dimal Police Station, that citizen EV is implicated in the criminal activity of distributing the narcotic substance cocaine, in the city of Dimal. From the data obtained, it resulted that this citizen carries out the criminal activity of distributing the narcotic substance cocaine, with high intensity, in the city of Dimal and beyond, which he has in various quantities. This citizen also owns a nightclub called “Star Club”, where it was proven that the customers, after consuming a large amount of alcohol, also sought narcotic substances, specifically cocaine. He keeps the narcotic substance hidden in one of the blocks of the surrounding wall of the club and has it divided into small doses of 0.2 gr to 0.5 gr, which he has ready for sale, where one dose was sold for the amount of 2000-5000 lek. After taking their dose of cocaine, the customers consumed it in the restrooms of the bar. In this activity, he was also assisted by the bar's bodyguard KD, the manager KI and the waiter RZ.

Nga të gjitha rrethanat e faktit dhe provat e mbledhura të analizuara si më sipër u provua tej çdo dyshimi të arsyeshëm që të pandehurit E.V., K.I, R. Z., dhe K.D., kanë realizuar tregtimin e lëndës narkotike të llojit “kokainë”, në mënyrë të vazhdueshme, të përsëritur dhe për një kohë të gjatë përdoruesve të lëndëve narkotike të cilët vinin në lokalin “Bar Star” dhe blinin lëndën narkotike.

Rezultatet e përftuara nga blerjet e simuluara të cilat janë pasqyruar të detajuara te rrethanat e faktit provojnë se të pandehurit shisnin në vazhdimësi lëndë narkotike personave të ndryshëm që vinin si klientë në lokalin “Bar Star”, ku lëndën narkotike të llojit “kokainë” e mbanin të fshehur jashtë lokalit në pjesën e mbrapme të tij, ku e merrnin në një kuti të vendosur te muri rrethues i lokalit, ndërsa pjesën tjetër të lëndës narkotike e mbanin të fshehur në banesën e të pandehurit E. V. Të pandehurit lëndën narkotike e quanin “amaro” në mënyrë që mos kuptoheshin kur bisedonin lidhur me lekët që kishin përfituar nga shitja e lëndës narkotike.

Nga analiza e provave dhe rrethanave të faktit provohet plotësisht se i pandehuri E. V. e kryente veprimtarinë e paligjshme në bashkëpunim dhe konkretisht në rolin e organizatorit dhe ekzekutorit. I pandehuri K.D., e ka kryer veprën penale në cilësinë e ekzekutorit. Ai ka ndjekur me përpikmëri detyrat e lëna nga bashkëpandehuri E. V. Edhe i pandehuri tjetër K.I., e ka kryer veprën penale në rolin e ekzekutorit, dhe ka ndërmarrë të gjitha hapat për ta realizuar plotësisht veprën penale. Ndërsa i pandehuri R.Z. e ka kryer veprën penale në rolin e ndihmësit, pasi ka ndërmarrë të gjitha veprimet e mundshme që vepra penale të realizohet plotësisht, duke marrë porositë nga klientët e lokalit për blerjen e lëndës narkotike dhe duke e përcjellë porosinë tek të bashkëpandehurit K.I. dhe K. D. të cilët kanë qenë në rolin e ekzekutorit pra shitësit të lëndës narkotike.

Sa më sipër, në përfundim të hetimit gjyqësor me kërkesë të Prokurorisë pranë Gjykatës së Shkallës së Parë të Juridiksionit të Përgjithshëm, Berat u vendos:

1. Deklarimi fajtor i të pandehurit E.V. për kryerjen e veprës penale të “Prodhimi dhe shitja e narkotikëve”, e kryer në bashkëpunim dhe dënimin e tij me 12 vite burgim. Në zbatim të nenit 406 pika 1, uljen e dënimit me 1/3, dhe dënimit e të pandehurit përfundimisht me 8 vite burgim;

2. Deklarimi fajtor i të pandehurit K.I. për kryerjen e veprës penale të “Prodhimi dhe shitje e narkotikëve” dhe dënimin e tij me 7 vite burgim. Në zbatim të nenit 406 pika 1, uljen e dënimit me 1/3, dhe dënimit e të pandehurit përfundimisht me 4 vite e 8 muaj burgim;

3. Deklarimi fajtor i të pandehurit K.D. për kryerjen e veprës penale të “Prodhimi dhe shitje e narkotikëve” dhe dënimin e tij me 7 vite burgim. Në zbatim të nenit 406 pika 1, uljen e dënimit me 1/3, dhe dënimit e të pandehurit përfundimisht me 4 vite e 8  muaj burgim; dhe

4. The guilty plea of ??the defendant RI for committing the criminal offense of "Production and sale of narcotics", and his sentence to 7 years of imprisonment. Pursuant to Article 406, point 1, the sentence is reduced by 1/3, and the defendant is ultimately sentenced to 4 years and 8 months of imprisonment. /CNA
