The Special Prosecutor's Office against Corruption and Organized Crime in Tirana has completed the preliminary investigations and submitted to the Special Court of First Instance for Corruption and Organized Crime the request for trial of criminal proceedings no. 188 of 2022, in charge of the defendants:

1. Julian Preni, investigated with a personal security measure "arrest in prison", accused of committing the criminal offense "Passive corruption of persons exercising public functions", provided by article 259 of the Criminal Code;

2. Arjel Balani, investigated with a personal security measure "arrest in prison", accused of committing the criminal offense "Exercising illegal influence on persons exercising public functions" provided by article 245/1, fourth paragraph of the Criminal Code ;

3. Foti Doda, investigated in a free state, accused of committing the criminal offense "Exercising illegal influence on persons exercising public functions", provided by article 245/1, second paragraph of the Criminal Code and "Active corruption of persons exercising public functions", provided by article 244 of the Criminal Code.

From the totality of acts and evidence administered during the investigation, which includes the statements of persons who have knowledge of the event, the statements of persons against whom investigations are conducted, the seizures of CDs with audio materials, the seizures of the phones of the defendants and the transcripts of audio materials, documentation administered by IKMT, etc., it is proven beyond reasonable doubt based on evidence that:

Citizens Sofia Doda and Foti Doda, have faced a problematic situation regarding the equipment with permission for the use of the beach in Ksamil, where years ago they had built an object.

The defendant Arjel Balani, being an employee in the Urban Planning Office of the Municipality of Saranda, has interacted with the defendant Foti Doda, asking him for the monetary amount of 12,000 (twelve thousand) Euros, in order to exert illegal influence on the National Coastal Agency, in order to issue a permit of using the beach. In July 2021, the defendant Arjel Balani took the amount of 6,000 (six thousand) Euros from these citizens, talking that they would give the rest when the permit was issued, but later the agreement was not reached. was realized and the defendant Arjel Balani has returned the monetary amount of 6,000 (six thousand) Euros.

The investigation also shows that the citizens Foti Doda and Sofia Doda had problems with the procedure followed for the demolition of a building built in Ksamil, for which the legalization procedures had started. During the inspections carried out by IKMT, in 2019, the entity "Foti Doda" was proceeded with administrative measure "demolition of the object". In March 2020, the defendant Julian Preni, on duty at that time - head of IKMT, Sarandë branch, asked the citizen Foti Doda, the monetary amount of 7,500 Euros, in order not to destroy the building he had built in Ksamil beach, and after negotiating, Foti gave Julian the sum of 3000 Euros. As a result of this corrupt action, citizen Foti Doda's building was not demolished in 2020, even though there was a demolition decision by IKMT since September 2019. From the documentation administered by IKMT, it appears that the object of citizen Foti Doda it was broken only on 07.06.2021./ CNA
