 "Let's go to court... you idiot!"/ Brother kicks brother

Edmond Daliu from Tirana went to the editorial office of the "Stop" show on TV Klan about a conflict with his brother.

They are co-owners of the same house, where they also have two other children, and Edmond has also built an addition next to this house, in which he is the sole owner. After returning from Italy, where he stayed with his daughter for three months, he finds the house turned into a shop.

He went to the police, but they told him to go to court. He went to live with a friend. In 2015, two of the co-owners, Leonardi and Alma, went to the Court of First Instance for the division of the real estate. With the reasoning that they live in the apartment, the court gave them the right to keep the house and compensate Edmond and his other sister.

"Hello, I am Edmond Daliu and I have a problem with my brother and sister-in-law. We have a shared apartment in the 'Myslym Shyri' area, where I own more than half of the house. We are co-owners of a part, the need for housing and like all the residents of the building I made an addition in 2005, I also have the ownership certificate. The other co-owners have not lived in that house for 20 years because they have their own houses. I could not buy a house and thought that building that addition would be enough for me, since I live alone. The problem is that I lived there and in 2010, when I went to Italy to see my daughter and when I returned I found the house turned into a shop, with shutters by my sister-in-law. I went to the police and they told me to go to court. Since 2010, with the help of my family and a friend of mine, I rented accommodation for many years", the informant confesses.

The decision became final a day later. Edmondi was unaware of this, so the deadline for appealing passed. At this point, he requested the Court of First Instance to reinstate the deadline to appeal, and this request was also accepted by the Appeals Court. Since 2018, he has been waiting for the decision of the Supreme Court. Today, Edmondi awaits justice, lonely, sick and homeless.

"It has been in the Supreme Court since 2018. They claim that they will buy the entire house. Now, while I am waiting for the court's decision, I retired and am on a minimum pension. I cannot afford to rent a house and live there. I have been living here on "Myslym Shyri" Street for more than a year in a former garage adapted for storage, which a friend of mine has. He has sheltered me until I solve the problem. The matter has become urgent for me because I am affected by a disease, one of the worst, Parkinson's. I hope that the "Stop" show will raise awareness of one of the biggest wounds that our society has, which are conflicts within the family, over property," Edmond Daliu adds.

The occupying brother, Leonard, refused to clarify the situation.

Journalist: Mr. Leonard, hello. I am a journalist from the show "Stop" and I am calling you about a property issue that you have with your brother. I would like us to meet and talk in person. How do you have the opportunity?

Leonard Daliu: Don't deal with these things! The court deals with them... you idiot!

Lawyer Arben LLangozi explains that the citizen should be able to enter his home since there is no final decision preventing him.

"Up until now, citizens have all the rights to own this property. I believe that, referring to the Constitution of the Republic of Albania, we have guaranteed the inviolability of the apartment, but referring to the Criminal Code, we have shortcomings regarding the violation of property. If a person unjustly holds property, the Criminal Code cannot fail to punish him. The very fact that a person unjustly holds the apartment hostage means that we have a violation of property, by misusing and mistreating it. I believe that this citizen should enjoy his apartment and the perpetrators who have it in illegal possession should be held accountable," said the lawyer./ Tv Klan
