Genc Huta from the Ali Demi area of ??Tirana is a citizen who, even though he won his property in the High Court, was unable to enjoy it for years due to the inaction of state institutions.

The Huta family was equipped with all the legal documentation and the ownership certificate, but during the updating process at the Municipality, it was discovered that an unauthorized building had been built on their land by the Shkoza family, while Sotir Shuka had erected a perimeter wall, occupying about 70 square meters of land.

"My name is Genci Huta. I own a property acquired in 2000, by decision of the Tirana Court. After the Court's action, I turned to the mortgage. We received the ownership certificates. After this action, I turned to the Tirana Municipality to update the property, which is located in the cadastral zone 81/80, with property number 8/270, surface area 368 m2. After I got acquainted with the place, I turned to the former Institute of Constructions at that time with the property. I requested the demolition of the building, because I found a building on my land. The procedures took quite a long time.

After many years, we managed to open a lawsuit. The people who built on my father's property are the Shkoza family.

I contacted them personally in the years 2000-2002 and we entered with some cousins ??outside their apartment. I asked for a contact. I asked them that since you built the silo, at least since I am the owner, give me a rent of whatever you think, 30 thousand lek, 50 thousand old lek. They did not accept. From that moment I started the procedures to demolish the building, in the meantime I found out that there is another citizen on my property, who is called Sotir Zhuka. He has surrounded a good part of my property with a perimeter wall", explains Huta.

After institutions refused to act to demolish the illegal construction, Genc Huta turned to the judiciary.

He won first in the first instance, then in the Appeals Court and, after 10 years, in the Supreme Court he managed to get the final decision in his favor. However, the property was not vacated.

"I filed a lawsuit with the District Court, seeking damages and release of property. Both for Sotir Zhuka and the Shkoza family. It decided to accept the lawsuit."

The Court of Appeal upheld the first instance decision in our favor. This decision of the Court of Appeal was appealed after we made an agreement with the progressive office, in April 2015, and when the family members received the notification from the bailiff's office, they filed a request for recourse.

The Supreme Court issued its decision in February 2025. The Supreme Court decided not to accept the appeal filed by the defendant. The decision has not yet been executed," Huta adds./ Tv Klan
