The instructions for the reorganization of universities change; Application through e-Albania, new rules for evaluation

In the event of a change or reorganization for the following academic year, universities in the country have until December 30th to submit applications to e-Albania.

Afterwards, the structures responsible for permits and licenses and the structures responsible for higher education in the ministry responsible for education will evaluate the applications and complaints according to the innovations approved in the instruction.

The Ministry of Education and Sports has approved the instruction that brings changes and additions to the existing regulation for the opening, reorganization and closure of higher education institutions, branches and study programs.

The additions and amendments to the instruction no. 1, dated 14.1.2020, “On the documentation and procedures for the opening, reorganization and closure of higher education institutions, their branches, main units and study programs, as well as for the division or merger of higher education institutions”, as amended, have been published in the Official Gazette.

One of the most important innovations is the addition of Chapter IV/1, which clearly defines the procedures for reviewing applications and complaints by the responsible structures in the ministry.

The instruction stipulates that the structure responsible for permits and licenses will review the documentation submitted by the entity, according to the request forms in e-Albania, for aspects of legal compliance.

For all applications, the assessments by the higher education structure will be based on market needs for new programs or reorganizations. According to the guidance, external experts from the list of the Agency for Quality Assurance in Higher Education (ASCAL) will also be included in the final assessment.

Institutions will be notified of the results of the assessments within the specified deadlines.

In case of complaints, clear procedures and cooperation with legal structures are foreseen for their review.

Changes to the instruction

In Instruction No. 1, dated 14.1.2020, “On the documentation and procedures for the opening, reorganization and closure of higher education institutions, their branches, main units and study programs, as well as for the division or merger of higher education institutions”, as amended, the following additions and changes are made:

a) Everywhere in the content of the instruction, the phrase "Ministry of Education and Sports" shall be replaced with the phrase "Ministry responsible for education".

"1. The higher education institution uploads the application to the e-Albania platform, for the reorganization of the HEI, according to the relevant form on the e-Albania platform, by December 30 for the following academic year, which is reviewed by the MES".

c) After Chapter IV, Chapter IV/1 is added, with the following content:

"CHAPTER IV/1 PROCEDURE FOR REVIEWING APPLICATIONS AND COMPLAINTS Based on the applications on the e-Albania platform, the structure responsible for permits and licenses and the structure responsible for higher education in the ministry responsible for education, evaluate the applications and complaints, according to the responsibilities below:

1. For all applications specified in this instruction, the structure responsible for permits and licenses reviews the documentation submitted by the entity, according to the request forms in e-Albania for aspects of legal compliance.

2. For all applications specified in this instruction, the structure responsible for higher education reviews the substantive aspects of the quality of the application, related to the assessment of market needs, the compliance of the criteria and quality standards required with those of the application.

According to the assessment, the structure responsible for higher education may request additional information on aspects related to the application within the specified deadlines.

3. The structure responsible for permits and licenses notifies the subject of the evaluation of the application, after the evaluation of the structure responsible for higher education, according to the deadlines set for each procedure.

4. The structure responsible for permits and licenses and the structure responsible for higher education propose external experts from the ASCAL list to the relevant authority.

5. After the final positive assessment by external experts, the structure responsible for permits and licenses and the structure responsible for higher education propose to the relevant authority the act according to the subject's application.

6. In cases of complaints, the structure responsible for permits and licenses and the structure responsible for higher education, in cooperation with legal structures, follow the procedures for reviewing complaints, according to the provisions of this instruction.” 2. The Ministry of Education and Sports and higher education institutions in the Republic of Albania are responsible for the implementation of this instruction.
