Complained by Veliaj for defamation, GJKKO dismisses the case against Berisha

The Special Court dismissed the case in charge of Sali Berisha, who was reported to SPAK by the Mayor of Tirana, Ervion Veliaj for defamation.

Judge Erjon Bani decided to dismiss the case, since Erion Veliaj did not appear at the hearing.

Announcement of GJKKO:

The accusing victim, Erjon Veliaj, on 22.11.2023 submitted to this Court the request for the trial of the criminal case with object: The guilty declaration of the accused Sali Berisha for committing the criminal offense of "Defamation", committed worldwide to the detriment of the accusing victim Erion Veliaj, provided by article 120/2 of the Criminal Code.
2. On 15.12.2023, a conciliation session was scheduled to take place in compliance with Article 338 of the Criminal Code. In this hearing, the accusing victim Erion Veliaj did not appear without reasonable cause.
Encountered in these conditions, the Special Court of First Instance for Corruption and Organized Crime with a panel composed of judge Erjon Bani, based on articles 59, 112 and 387 of the Penal Code as well as on the Unifying Decision No. 11, dated 14.10.2011 of the United Colleges of the Supreme Court, with decision No. 83, dated 15.12.2023, decided:
Dismissal of the criminal case with No. Basic Register 126, registration date 22.11.2023, with Accusing Victim: Erion Veliaj; accused: Sali Berisha for the criminal offense of "Defamation" provided for by Article 120/2 of the Criminal Code.
Court costs are charged to the accusing victim Erion Veliaj.
Against this decision can be appealed to the Special Court of Appeal against Corruption and Organized Crime, within 15 (fifteen) days, starting from the day after the notification of this decision./< /span>CNA
