The tax administration has warned that it will re-categorize the income of the self-employed, in cases that result in inaccurate data from self-declarations.

In the amendments to the guidance of the law "On Income Tax", 5 examples have been published with cases where self-employed persons are considered real and when fictitious.

Many high-paid employees employed by companies, in order to avoid taxes or reduce tax liabilities, left the payroll and registered as self-employed individuals.

To identify the true self-employed, the 2026 fiscal package approved several amendments to the law "On Tax Procedures", which introduced the obligation for self-declaration of data for this category.

According to the approved changes to the fiscal package, by March 2026, all self-employed individuals who receive over 80% of their income from a single client or over 90% from fewer than three clients must self-declare data on services, work methods, etc. in order to verify the source of income.

The self-declaration will be carried out by completing the "Self-Employed Status Declaration" form, which is then submitted to the tax administration.

A self-employed individual, registered with the activity “Services for artistic performances”, during the tax year 2025 realizes gross income in the amount of 3,500,000 lek. Of this income, 2,900,000 lek, or about 83% of the total, is realized by a single tax resident client in the Republic of Albania, while the rest of the income is realized by two other different clients. Referring to the letter “ç”, point 1, of article 12 of the law, this individual would meet the criteria to be treated as income from employment for tax purposes. However, the self-employed individual, assessing the concrete circumstances of the economic relationship with the client, submits to the regional tax directorate the Declaration of Self-Employed Status, in which he declares that he is not in the conditions of income from employment. The declaration is submitted within the month of March, together with the Annual Declaration of Personal Income Tax from Business. In this case, until a contrary assessment by the tax administration, the income of the self-employed individual is treated as income from business, and the individual fills in the relevant columns of business income in the Annual Tax Declaration of Personal Income Tax from Business. The tax administration, in exercising its powers in implementation of the law on tax procedures, uses the Declaration of Self-Employment Status as an assessment tool for further verification to determine whether or not this taxpayer is in the conditions of tax avoidance.

Një doktor me iniciale “A.N.” është i vetëpunësuar, ka një kontratë shërbimi me një spital dhe përfiton të ardhura vjetore prej 200.000 lekësh, sipas faturimit që kryen kundrejt spitalit. Gjatë ushtrimit të detyrës ai përdor pajisjet e spitalit (aparatura, sallat, zyrat, materialet mjekësore) pa investuar vetë. Pacientët që mjekon i siguron spitali, nuk i sjell ai vetë. Ai e ushtron detyrën në orarin e përcaktuar nga spitali. Spitali mbikëqyr punën e tij dhe vendos rregullat që ai duhet të ndjekë gjatë ushtrimit të detyrës sipas rregulloreve të spitalit. Pra, pavarësisht se doktori “A.N.” sillet si një vetëpunësuar, në fakt sjellja e tij është e njëjtë me atë të një të punësuari pasi ai është i varur nga spitali për punën dhe mjetet, ai nuk mbart risk financiar, prandaj për qëllime tatimore ai do të trajtohet si punonjës i spitalit.

Një kuzhinier me iniciale “B.C.” ushtron profesionin si i vetëpunësuar në restorantin “Z” dhe nuk mund ta delegojë apo zëvendësojë me dikë tjetër veten e tij. Restoranti ku ai punon, ka investuar mbi të gjitha pajisjet e kuzhinës dhe furnizon të gjitha materialet që i duhen kuzhinierit “B.C.” për të kryer punën e tij. Gjithashtu, restoranti ka përcaktuar dhe orarin dhe ditët e punës të kuzhinierit “B.C.” Ai paguhet me pagë fikse mujore 250,000 lekë pavarësisht qarkullimit që kryhet në restorant, sipas kontratës që ka me restorantin. Pra, kuzhinieri “B.C.” në këtë rast është një punonjës i restorantit, pavarësisht sjelljes së tij si i vetëpunësuar, për arsye se sjellja e tij është e njëjtë me atë të një punonjësi, ai nuk mbart risk dhe puna e tij kontrollohet tërësisht nga restoranti.

Personi i vetëpunësuar me iniciale “E.D.” është një shkrimtar. Ai përdor mjetet e veta (kompjuter, printer etj.) për shkrimet e tij. Punën ai e kryen në ambientet e shtëpisë së tij dhe orarin e punës e ka të papërcaktuar. Shkrimet e tij mund të jenë në forma të ndryshme (si libër apo artikuj të ndryshëm). Për çdo shkrim të tij, ai merr pagesën përkatëse, sipas marrëveshjes që bën me shtëpinë botuese apo redaksinë që ai zgjedh vetë. Ky shkrimtar në këtë rast është kontraktor i pavarur, për arsye se e gjithë puna bazohet në krijimtarinë e tij të pavarur dhe nuk kontrollohet apo drejtohet nga një shtëpi botuese apo redaksi, dhe në këtë mënyrë është ai që mbart dhe riskun e të ardhurave të tij

Arditi, një hidraulik me përvojë, ka rënë dakord me një kompani për të kryer shërbime me kohë të plotë në kantieret e ndërtimit si i vetëpunësuar. Ai përdor mjetet e tij personale dhe kryen punën sipas rendit dhe specifikimeve të përcaktuara nga kompania. Kompania furnizon të gjitha materialet, kryen inspektime të shpeshta të punës së tij, e paguan atë sipas sasisë së punës së kryer. Arditi nuk ka një vendndodhje biznesi dhe nuk kërkon të ofrojë shërbime të ngjashme për palë të tjera. Të dyja palët mund ta ndërpresin marrëdhënien në çdo kohë.
