The General Assembly of the National Chamber of Private Bailiffs raises the alarm that the Private Bailiff Service in Albania is in danger.
In a public position of the assembly, it is emphasized that this profession is endangered and affected by the dysfunction of the state links.
In response, it is underlined that some individuals with bailiff licenses, who are not part of the assembly, in cooperation with some microfinance companies violate the laws of the country.
The private executors ask the justice bodies to impose the force of the law on those persons who are desecrating the profession and violating the citizens in its name.
"The lack of efficiency of the courts in the wind of the new justice system is another danger that threatens this profession every day and more. The public image of the private bailiff has been hit hard, by some individuals with a bailiff's license, who we refuse to be part of us. We have publicly denounced those who, together with the microfinance companies, dared to deceive thousands of citizens, with seizures, auctions and fictitious enforcement procedures. We ask the justice bodies to impose the force of the law on these "enforcers" who they defiled the profession and violated the citizens in its name", the reaction says, among other things.
Furthermore, it is emphasized that any attempt to undermine the image and activity of the President of the Chamber, Tedi Malaveci, is considered an infringement of the image and activity of the entire National Chamber of Private Bailiffs.
Full stance:
Today, on 21.12.2023, We, the General Assembly of the National Chamber of Private Bailiffs, who are the highest representative and decision-making body of this legal organization, decided to take this public position:
The Private Judicial Enforcement Service in Albania is in danger. Endangered as a profession. Struck as a public image. Admitted to its governing bodies. Our profession has been hit hard by the dysfunction of the state links, as a whole, where the government's inattention to the economic incentives of this legal service and
the dysfunction in accordance with the legal requirements of some state entities stand out in recent years.
The lack of efficiency of the courts in the spirit of the new justice system is another danger that threatens this profession every day and more. The public image of the private bailiff has been hit hard, by some individuals with bailiff licenses, who we refuse to be part of us. We have publicly denounced those who, together with microfinance companies, dared to deceive thousands of citizens, with seizures, auctions and fictitious enforcement procedures.
We ask the justice bodies to impose the force of the law on these "enforcers" who defiled the profession and violated the citizens in its name.
We condemn them, like their accomplices, outside the executive service, recently engaged in continuous efforts to anathematize the representative image of the House. We, the General Assembly of the National Chamber of Private Bailiffs, will not allow any individual, with or without a bailiff's license; no entity inside or outside the executive branch, to discuss or question our will to elect our representatives.
The current Speaker of the House, like all governing bodies, is elected in a free voting process and represents the absolute will of the majority of the General Assembly, before the legislative, executive and judicial powers, in the interest of the body of private bailiffs.
Any attempt to undermine the image and activity of the President of the Chamber, who has at all times and in the best way represented the legitimate interests of the membership, in accordance with the law and the representation fees defined in the Statute, is considered an infringement of the image and activity of the entire National Chamber of Private Bailiffs.
We encourage institutions and public opinion to see the private bailiff as their ally, in the difficult mission of regaining the lost ground of Justice./ CNA
