Bardhi's lawsuit against Nikolla/ GJKKO makes the decision, does not start

GJKKO has upheld SPAK's decision not to initiate an investigation into the Speaker of the Parliament, Lindita Nikolla, as the latter was sued by the head of the DP group, Gazment Bardhi.

Bardhi sued Nikolla for abuse of office since, according to the head of the DP group, Nikolla had allowed armed guards in the Assembly hall.

MEDIA ANNOUNCEMENT

The Special Prosecutor's Office against Corruption and Organized Crime, on the basis of the criminal report of the citizen Gazmend Bardhi, in the capacity of the Chairman of the Parliamentary Group of the Democratic Party, made against the citizen Lindita Nikolli in the capacity of the Speaker of the Assembly of Albania, has registered the criminal report No. 245 of 2023, for the criminal offense of "Abuse of duty" provided for by Article 248 of the Criminal Code.

After evaluating the above-mentioned criminal report, the Special Prosecutor's Office Against Corruption and Organized Crime decided on 22.11.2023: "1. Non-initiation of criminal proceedings for criminal report No. 245 of 2023. 2. The decision to be notified to the interested parties. 3. An appeal can be made against this decision in the Special Court of First Instance for Corruption and Organized Crime within 10 (ten) days from the announcement of the decision."

The above decision was appealed to the Court by the complainant on 11.12.2023. Regarding the examination of this request, the Court decided to examine it in the consultation room without the presence of the parties and the court secretary in compliance with Article 291 point 3 of the Penal Code. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime with a panel composed of judge Erjon Bani, based on articles 75/a, 112, 290 and 291 of the Code of Criminal Procedure, as well as article 248 of the Criminal Code, with decision No. 496, dated 22.12.2023, decided:

The enforcement of the decision of the Special Prosecutor's Office against Corruption and Organized Crime in Tirana "On the non-initiation of the criminal proceedings pertaining to report No. 245 dated 08.11.2023", dated 22.11.2023.

Court costs are charged to the appellant.

Against this decision, an appeal can be made to the Special Court of Appeal for Corruption and Organized Crime within 10 (ten) days, starting from the day after the announcement of this decision.
