Economic operators of land, air and water passenger transport will pay a fee of 200 lek per passenger for the transfer of passenger data to the systems of the Travel Intelligence Sector.
The government meeting approved a decision that defines the rules, measures, exceptions and procedure for the collection and administration of the fee for the transmission of travel information in the systems of the Travel Intelligence Sector. This decision applies to all land, air and water carriers operating in the territory of Albania.
The fee for this service is set at 200 lek per passenger for the first year, and will be reviewed every 3 years after that, based on the actual costs of the service. The revenue will be used to cover the costs of transmission, transformation and provision of travel information.
According to the decision, carriers will report the number of passengers transported every month, while the economic operator will issue the relevant invoices for the payment of the fee. Exemptions from the fee have also been determined, such as for passengers under the age of 2, humanitarian trips and state transport of emergency missions.
In cases of technical defects or extraordinary situations, carriers are exempt from administrative sanctions.
This decision entered into force after publication in the Official Gazette and will be implemented by the Ministry of Internal Affairs and the State Police.
ON DETERMINING THE RULES, MEASURES, EXCEPTIONS FROM SANCTIONS AND PROCEDURE FOR THE COLLECTION AND ADMINISTRATION OF THE TARIFF FOR THE TRANSMISSION OF TRAVEL INFORMATION
In accordance with Article 100 of the Constitution and point 2, Article 6, of Law No. 38/2025, “On the processing of travel information in the Republic of Albania”, upon the proposal of the Minister of Internal Affairs, the Council of Ministers
DECIDED:
GENERAL PROVISIONS
This decision determines the rules, the amount, exemptions from sanctions and the procedure for the collection and administration of the fee, which is paid by carriers that transmit travel information to the systems of the Travel Intelligence Sector.
The terms used in this decision have the same meaning as those defined in Law No. 38/2025, “On the processing of travel information in the Republic of Albania”.
This decision applies to all land, air and water carriers operating in entry, exit or transit through the territory of the Republic of Albania, in accordance with Law No. 38/2025, "On the processing of travel information in the Republic of Albania".
MEASURES, RULES AND PROCEDURES FOR THE COLLECTION AND ADMINISTRATION OF THE TARIFF
The fee for the transmission of travel information, for one year from the entry into force of this decision, is 200 (two hundred) lek per passenger. After the first year, the fee value is reviewed and set at a fixed value, reviewable every 3 (three) years.
The revenue from this fee is used to cover the costs of transmitting and transforming travel information.
The fee is determined in accordance with the principles of real cost of service, efficiency and periodic review.
The fee value consists of:
a) the cost of technological infrastructure (servers, security equipment, software licenses);
b) operational cost (maintenance, technical support, communication with carriers' systems);
c) the cost of continuous data transfer to the Travel Intelligence Sector;
ç) the cost of data transformation and processing in the formats approved in the travel data processing regulation;
d) the cost of data security and auditing;
dh) the economic operator's administrative cost of managing and processing requests related to the transmission or transformation of travel data.
For the tariff review, the economic operator shall submit a detailed financial report, explaining the existing and new costs justifying the tariff change. The detailed financial report shall be verified and approved by the Travel Intelligence Sector and shall include all cost items, including maintenance, security, licenses, operational expenses, compared to the amount of data transmitted.
The procedure for collecting and administering the fee is as follows:
a) Carriers, within the 5th (fifth) of each month, submit to the Travel Intelligence Sector the data report on passengers transported in the previous month;
b) The Travel Intelligence Sector, within 5 (five) working days, verifies and confirms the data on the number of passengers and presents these to the economic operator that will provide the service of transmission and transformation of travel information;
c) The economic operator, within 5 (five) days from the confirmation of the Travel Intelligence Sector, produces and notifies the respective monthly invoice to each carrier obliged to transmit data, based on the number of passengers and for whom travel data has been transmitted;
ç) A copy of the invoice produced is sent to the Travel Intelligence Sector, together with information regarding the moment of notification of the invoice to the carrier;
d) Payment is made by the carrier to the account of the economic operator that will provide the travel information transmission service, within 30 (thirty) days from the moment of notification of the invoice;
dh) In case of non-payment of the fee, according to the deadlines set out in this point, the provisions of Law No. 48/2014, “On late payments in contractual and commercial obligations”, as amended, shall apply;
e) The administration of the tariff is carried out by the economic operator that will provide the service for the transmission and transformation of travel information and is used for the purpose for which the tariff was established;
ë) The economic operator has the obligation to ensure full transparency in the administration of the tariff, by maintaining accurate and traceable records of every payment made by carriers or their representative operators;
f) The economic operator is obliged to report quarterly to the Travel Intelligence Sector on the number of carriers covered, the services provided and the total value of the fees collected. The reports shall be accompanied by supporting financial and technical documentation.
The following are exempt from paying the fee:
a) passengers under the age of 2 (two) years, without a reserved seat;
b) travel for humanitarian purposes, confirmed by state authorities;
c) transports carried out by state structures, in function of special security or emergency missions.
Transporters or economic operators are exempt from the application of the sanctions provided for in letter "dh", point 6, of this decision, in cases of:
a) unexpected technical defects in transmission systems, proven and documented;
b) force majeure (natural disasters, states of emergency, confirmed by decision of a public body, cyberattacks), which make transmission objectively impossible;
c) prior or immediate notification of the problem and cooperation with the Travel Intelligence Sector to correct it;
ç) correction of the violation within a reasonable time, when no consequences have occurred.
III. The Ministry of Internal Affairs and the General Directorate of the State Police are charged with the implementation of this decision.
