The Special Court has found guilty and sentenced 2 defendants on charges of active and passive electoral corruption.

The decision for Pandeli Bozha and Vladimir Lushka was converted by the GJKKO into probation and expungement.

The decision of the GJKKO:

The Special Prosecution Office against Corruption and Organized Crime has submitted to the Court the request with the subject: "Trial of the criminal case pertaining to criminal proceedings no. 60/1, of 2025, against the defendants: Pandeli Bozha, accused of committing the criminal offense "Active corruption in elections", provided for by Article 328 of the Criminal Code and Vladimir Lushkaj, accused of committing the criminal offense "Passive corruption in elections", provided for by Article 328/bi of the Criminal Code".

The trial of this case was conducted under the rules of summary trial. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of judges Etleva Deda, Irena Gjoka and Bib Ndreca, with decision no. 1, dated 13.01.2026, decided:
1. The guilty plea of ??the defendant Pandeli Bozha for committing the criminal offense of “Active corruption in elections”, provided for by Article 328 of the Criminal Code and his sentence to 1 (one) year and 6 (six) months of imprisonment.

-In application of Article 406, this measure reduces the sentence by 1/3 of the sentence and ultimately reduces his sentence to 1 (one) year of imprisonment.

-In application of Article 59 of the Criminal Code, the suspension of the execution of the decision to imprison and the placing of the convicted person on probation, provided that during the probation period he does not commit another criminal offense, for a period of 24 months.

The guilty plea of ??the defendant Vladimir Lushkaj for committing the criminal offense of “Passive corruption in elections”, provided for by Article 328/b of the Criminal Code.
- Pursuant to Article 52/b of the Criminal Code, the exemption from punishment of the defendant Vladimir Lushkaj.

Regarding the material evidence, the Court disposes as follows:
a banknote in the amount of 2000 lek, given that it is a reward given for the criminal offense, in accordance with Article 36/1/c of ??the Criminal Code, shall be transferred in favor of the state.

– a sheet similar to those of the ballots where the name of the candidate for LB MP was colored orange, to become part of the trial file.

The procedural expenses incurred during the preliminary investigation phase in the amount of 6,361.52 (six thousand three hundred sixty-one point fifty-two) lekë, the preliminary hearing and during the trial, according to the minutes attached to this decision, are jointly and severally charged to the defendants.
An appeal is allowed against this decision within the legal deadline, to the Special Court of Appeal for Corruption and Organized Crime. /CNA
