"Diesel compensation 50 lek per liter"/ The government's proposal

In the meeting held today with public transport associations, the government has proposed providing compensation of 50 lek per liter for diesel. The compensation is expected to be provided for 3 months. The compensation is expected to benefit all public transport operators in the country.

The National Association of Urban Transport and the National Association of Urban and Intercity Transport have requested a subsidy of 100 lek per liter, a scheme similar to 2022.

Regarding the proposed subsidy of 50 lek per liter, Kostandin Foni, president of the Public Transport Association, told Monitor that it does not cover the additional costs from the increase in fuel prices. However, he positively assessed the ministers' proposal as a first step to continue the normality of the service.

"In the coming days, we expect to hold a meeting with Ministers Ibrahimaj and Karakaçi to discuss the operating costs for the categories that travel for free, but also our requests for the removal of the excise tax on oil and the reduction of VAT. Only their approval would guarantee sustainability for the public sector, which has been in difficulty since Covid-19 ," said Foni.

Due to cost difficulties, the day before, public transport service was reduced by up to 60% across the country.

The operators of 450 transport lines in the country warned of further escalation if there was no reaction from the institutions.

Public transport anti-crisis package delivered to ministers Ibrahimaj and Karakaçi

In the context of the significant and continuous increase in fuel prices, which has created a deep imbalance between the real operating costs and the unchanged revenues of the sector, we present for discussion the following priority requests, based on legal precedents and the need to guarantee an essential public service:

1. Adoption of an emergency anti-crisis package, in line with existing precedents

Immediate intervention is required through a financial support package, taking as a legal and practical basis the Council of Ministers' Decision No. 225, dated 13.04.2022 "On determining the procedures, documentation and compensation amount for urban, suburban and intercity transport companies, part of the anti-crisis package", which was approved in similar crisis conditions to compensate fuel costs for public transport operators with 100 lek/liter. This decision, based on Article 100 of the Constitution and budgetary legislation (the law on the state budget), has sanctioned the principle of state intervention in extraordinary situations to guarantee the continuity of a vital public service.

Nga të dhënat e përgjithshme rezulton se paketa financiare e asaj periudhe ka qenë në vlerën rreth 500 milionë lekë, nga e cila është përdorur rreth 55–60% e fondit, për një periudhë rreth 6-mujore.

Ky precedent provon qartë se ndërhyrja është e mundur dhe e justifikuar ligjërisht, efekti financiar është i përballueshëm për buxhetin e shtetit dhe mekanizmi i kompensimit është i zbatueshëm dhe i verifikueshëm përmes dokumentacionit tatimor dhe kontrollit administrativ.

Në këto kushte, kërkohet riaktivizimi i një skeme të ngjashme, të përshtatur me nivelin aktual të çmimeve dhe kostove reale të sektorit.

2. Rishikimi i menjëhershëm i barrës fiskale, heqja e taksës së qarkullimit

Duke qenë se taksa e qarkullimit përbën një komponent të rëndësishëm në strukturën e çmimit të karburantit, kërkohet pezullimi ose përjashtimi i përkohshëm i saj për operatorët e transportit publik. Kjo taksë është e përcaktuar në Ligjin nr. 9975, datë 28.07.2008 “Për taksat kombëtare”, i ndryshuar, në nivelin 27 lekë/litër, së bashku me taksën e karbonit prej 3 lekë/litër, dhe aplikohet në mënyrë të njëtrajtshme mbi benzinën dhe gazoilin.

Duke qenë një barrë fikse që përfshihet në çmimin final, ajo rëndon proporcionalisht më shumë në kushtet e rritjes së çmimeve të tregut. Në funksion të interesit publik dhe duke marrë në konsideratë natyrën e veçantë të transportit publik si shërbim social, pezullimi i kësaj takse për këtë sektor përbën një masë të justifikuar dhe të mbështetur në parimin e proporcionalitetit fiskal.

3. Heqja ose pezullimi i akcizës mbi karburantin për këtë sektor

Akciza mbi karburantin, e përcaktuar po në kuadër të Ligjit nr. 9975/2008 dhe legjislacionit fiskal përkatës, aplikohet në nivelin rreth 39.4 lekë/litër për naftën dhe përbën një nga komponentët kryesorë të çmimit final. Si taksë indirekte me efekt të drejtpërdrejtë në koston e operimit, ajo rëndon ndjeshëm mbi operatorët e transportit publik, të cilët nuk kanë mundësi të transferojnë këtë kosto te konsumatori për shkak të tarifave të rregulluara.

Në këto kushte, vazhdimi i aplikimit të akcizës në të njëjtin nivel krijon një disproporcion të dukshëm ndërmjet barrës fiskale dhe kapacitetit ekonomik të sektorit, duke cenuar parimin e drejtësisë dhe proporcionalitetit në taksim. Vetë legjislacioni shqiptar parashikon përjashtime për sektorë të caktuar (si peshkimi), çka përforcon argumentin për trajtim të diferencuar edhe për transportin publik.

4. Heqja e TVSH-së

TVSH-ja, e rregulluar nga Ligji nr. 92/2014 “Për tatimin mbi vlerën e shtuar”, aplikohet në nivelin standard 20%, duke rritur drejtpërdrejt çmimin përfundimtar dhe duke kufizuar aksesin në këtë shërbim esencial. Duke qenë se transporti publik përmbush një funksion social dhe ekonomik, si dhe duke marrë në konsideratë praktikat e vendeve të rajonit ku kjo normë varion nga 0% deri në 5%, kërkohet heqja e plotë ose reduktimi i TVSH-së.
