The Constitutional Court has today ruled on the requests of 38 Democratic Party deputies regarding the establishment of two investigative committees.
The court has rejected the DP's request to establish an Investigative Commission to verify the legality of the actions of Albanian officials in relation to former FBI special agent Charles McGonigal. According to the decision, the request does not meet the constitutional criteria for establishing this investigative commission.
Meanwhile, on the other hand, the Constitutional Court has accepted the request for the establishment of an Investigative Commission "For the control of the legality of the activity of central and local government bodies, as well as to verify the use of state administration resources for electoral purposes in the elections of May 11, 2025".
FULL DECISION:
The Constitutional Court, on 05.05.2026, considered in a public plenary session the case with the petition of a group of 38 deputies of the Assembly of Albania (more than a quarter of the deputies), with the object: “1. Resolving the dispute of competence between no less than a quarter of the deputies and the Assembly of the Republic of Albania, by determining the obligation of the Assembly to establish the Investigative Committee of the Assembly: (1) “On verifying the legality of the actions of Albanian officials in relation to former FBI special agent Charles McGonigal (ii) “On controlling the legality of the activities of central and local government bodies, as well as verifying the use of state administration resources for electoral purposes in the elections of May 11, 2025”. 2. Declaration of decision no. 77/2025 of the Assembly of Albania “On the non-approval of the draft decision “On the establishment of the Investigative Commission to verify the legality of the actions of Albanian officials in relation to the former FBI special agent Charles MCGonigal””, as incompatible with the Constitution of the Republic of Albania. 3 Declaration of decision no. 78/2025 of the Assembly of Albania “On the non-approval of the draft decision “On the establishment of the Investigative Commission to control the legality of the activities of central and local government bodies, as well as to verify the use of state administration resources for electoral purposes in the elections of May 11, 2025””, as incompatible with the Constitution of the Republic of Albania.”.
The Constitutional Court, convened today on 01.06.2026, after reviewing the claims and objections of the parties, in a summary manner, found that:
1. Kërkuesi legjitimohet për vënien në lëvizje të gjykimit kushtetues. Kërkesa është paraqitur nga i njëjti grup deputetësh që ka kërkuar edhe ngritjen e dy komisioneve hetimore. Numri i deputetëve plotëson pragun kushtetues prej një të katërtës së numrit të deputetëve të Kuvendit sipas nenit 77 pika 2 të Kushtetutës, që kanë kompetencën për të detyruar Kuvendin në ngritjen e komisionit hetimor. Kërkesa është paraqitur në Gjykatë në datën 12.11.2025, pra brenda 6 muajve nga çasti i lindjes së konfliktit, më 30.10.2025, kur Kuvendi vendosi mosmiratimin e ngritjes së dy komisioneve hetimore në seancë plenare.
2. Në lidhje me themelin e pretendimeve, që lidhej me cenimin e të drejtës së deputetëve për ngritjen e komisionit hetimor, Gjykata vlerësoi:
a) me shumicë votash ndonëse me linja të ndryshme arsyetimi, se kërkimi për zgjidhjen e mosmarrëveshjes së kompetencave të krijuar nga vendimi nr. 77/2025 të Kuvendit të Shqipërisë “Për mosmiratimin e projektvendimit “Për ngritjen e Komisionit Hetimor për verifikimin e ligjshmërisë së veprimeve të zyrtarëve shqiptarë në raport me ish-agjentin special të FBI-së Charles MCGonigal dhe shfuqizimin e këtij vendimi, si t papajtueshëm me Kushtetutën e Republikës së Shqipërisë, nuk duhet pranuar, pasi nuk plotëson kriteret kushtetuese për ngritjen e këtij komisioni hetimor. Gjykata nuk arriti shumicën e kërkuar nga ligji për të vlerësuar kriterin kushtetues “çështje e veçantë të lidhur edhe ekzistencën e indicieve të qarta, për shkak të qasjeve të ndryshme në arsyetim. sipas të cilave ky komision nuk duhej ngritur për shkaqe që lidheshin me indiciet apo parimin e ndarjes së pushteteve. Për rrjedhojë, ky kërkim bazuar në nenin 73, pika 4, 12 Ligiin Organik të Gjykatës konsiderohet i rrëzuar,
b) njëzëri, ndonëse me linja të ndryshme arsyetimi, se kërkimi për zgjidhjen e mosmarrëveshjes së kompetencave të krijuar nga vendimi nr. 78/2025 të Kuvendit të Shqipërisë “Për mosmiratimin e projektvendimit “Për ngritjen e Komisionit Hetimor për kontrollin e ligjshmërisë së veprimtarisë së organeve të pushtetit qendror dhe pushtetit vendor, si dhe për të verifikuar përdorimin e burimeve të administratës shtetërore për qëllime elektorale në zgjedhjet e 11 majit 2025”, si dhe shfuqizimin e këtij vendimi, si të papajtueshëm me Kushtetutën e Republikës së Shqipërisë, duhet pranuar, pasi plotëson njëkohësisht kriteret kushtetuese të ngritjes së komisionit hetimor sipas nenit 77, pika 2, të Kushtetutës dhe jurisprudencës kushtetuese.
Për sa më sipër, Gjykata Kushtetuese, në mbështetje të neneve 77 dhe 131, pika 1, shkronja “c” të Kushtetutës, si dhe të neneve 54, 55, 56, 72 e vijues të ligjit nr. 8577, datë 10.02.2000 “Per organizimin dhe funksionimin e Gjykatës Kushtetuese të Republikës së Shqipërisë, me shumicë votash, vendosi1. Pranimin e pjesshëm të kërkesës.
2. Resolving the dispute over competence between a quarter of the deputies and the Assembly of the Republic of Albania, by determining the obligation of the Assembly to establish the Investigative Commission "On the control of the legality of the activity of central and local government bodies, as well as to verify the use of state administration resources for electoral purposes in the elections of May 11, 2025".
3. Repeal of Decision No. 78/2025 of the Assembly of Albania “On the non-approval of the draft decision “On the establishment of the Investigative Commission to control the legality of the activity of central and local government bodies, as well as to verify the use of state administration resources for electoral purposes in the elections of May 11, 2025 ^ … as incompatible with the Constitution of the Republic of Albania.
This decision is final and enters into force on the day of publication in the Official Gazette.
The final decision will be announced, justified within the legal deadlines provided for by the Organic Law of the Court and by the Rules of Procedure of the Constitutional Court. /CNA
