The Zurich-based organization "Diaspora for a Free Albania" has condemned the attacks by Tirana Mayor Erion Veliaj, Prime Minister Edi Rama and the denigrating news published in government-run media about prosecutor Olsi Dado and judge Erjon Bani. The denigrating statements and open pressure on SPAK began on Monday after the arrest of Tirana Mayor Erion Veliaj on charges of passive corruption in 9 cases and money laundering.
DPSHL has demanded a reaction from the institutions because, as stated in the statement, threats and denigration violate the sacred principle of "Maintaining the authority and impartiality of the judiciary".
The DPSHL protest note highlights the attacks by Veliaj, Rama, and media articles addressed to Bani and Dada over the past few days, considering them deeply disturbing.
"Honored representatives of institutions, missions and media in Albania,
We, the Albanian citizens of the Diaspora, committed to protecting the principles of the rule of
law and the integrity of the justice system in Albania, express our deep concern
about the continued public attacks against judges and prosecutors who are handling
important criminal and corruption cases.
The denigrating publications and statements spread in the media, which directly undermine
the professionalism, authority and independence of magistrates, are in flagrant contradiction
with the sacred principle of "Maintaining the authority and impartiality of the judiciary"
, which is protected by the Constitution of the Republic of
Albania, the European Convention on Human Rights (ECHR), as well as the Criminal Code and the Code of
Criminal Procedure of the Republic of Albania. A state of law, and a candidate for
membership in the European Union, cannot tolerate these practices that undermine
public trust in justice and help create pressure on magistrates to divert the handling
of cases of high public interest.
Deklaratat e bëra pas arrestimit të tij, nga Kryetari i Bashkisë së Tiranës, Erion Veliaj, si dhe
deklarata të mëparshme kundër sistemit të drejtësisë të bëra nga politikanë të tjerë të
pozitës dhe opozitës, minojnë parimin e shtetit të së drejtës dhe autoritetin e pushtetit gjyqësor.
Shpesh deklaratat e tyre përbëjnë vepër penale sipas Nenit 318 të Kodit Penal i cili sanksionon
se: "Fyerja e gjyqtarit apo anëtarëve të trupit gjykues, prokurorit, avokatit ose anëtarit të
arbitrazhit, për shkak të veprimtarisë së tyre në një çështje, përben kundërvajtje penale dhe
dënohet me gjobë ose me burgim gjer në tre muaj."
Së fundmi, një skandal i rëndë ka përshirë mazhorancën qeverisëse, ku Kryeministri i
Republikës së Shqipërisë i ka drejtuar një deklaratë të papranueshme një institucioni
kushtetues si SPAK dhe tërë sistemit të drejtësisë, duke deklaruar: "Mos të gabojnë të
kërkojnë telefonin tim." Një sjellje e tillë minon shtetin e së drejtës dhe shpresat e Shqipërisë
për integrimin e vërtetë në BE, pasi synon të pengojë institucionet e drejtësisë në detyrën e tyre
dhe të nxisë pandëshkueshmërinë, duke dhënë mesazhin se dikush në Shqipëri mund të jetë mbi
ligjin, qofshë ky edhe Kryeministri.
U bëjmë thirrje mediave që të jenë mjaft të kujdesshme dhe të respektojnë standardet e
vendeve të zhvilluara dhe të Bashkimit Evropian, duke ushtruar autocensurë dhe kujdes kur
bëhet fjalë për mbrojtjen parimit kushtetues të autoritetit të pushtetit gjyqësor. Mediat nuk
duhet të publikojnë kurrësesi deklarata nga persona në hetim, të pandehur ose avokatët e
tyre në lidhje me çështje që janë në proces hetimi apo gjyqësor, duke shmangur kështu
ndikimin mbi opinionin publik dhe proceset e drejtësisë.
WE URGENTLY REQUEST:
1. A public statement by the High Judicial Council and the High Prosecutorial Council,
denouncing and condemning unjust attacks against judges and prosecutors, and
reaffirming the institutional protection of the independence of the judiciary.
2. A statement by the Special Prosecutor’s Office SPAK, warning that it will pursue
legal action to prohibit statements and publications that harm investigations and harm
the image of magistrates, including initiating criminal prosecution for insulting
magistrates.
3. In accordance with international best practices, the submission by the
Special Prosecutor’s Office SPAK, in court, of a legal request to prohibit the publication of
statements by persons under investigation, defendants and their lawyers in
public media, as long as the statements affect the independence of justice and the
due process of law.
Why are we requesting these measures?
To protect the integrity of judges and prosecutors who face unfair pressures
. To guarantee a fair, impartial criminal trial free from political or
media influence.
To strengthen citizens' trust in justice reform and the rule of law.We, the Diaspora for a Free and Just Albania, will continue to closely monitor
developments and denounce anyone who undermines the institutions of justice and endangers the
democratic and European future of Albania, the statement says./ CNA
