Regulation enters into force/ How to apply and document for pension for years of

The regulation that paves the way for the recognition of periods of work in former state-owned enterprises before 1993, for the purpose of pension benefits, enters into force.

According to the regulation "On the implementation of Law No. 7/2025, "On the recognition of periods of employment in state institutions, former state enterprises, former agricultural enterprises and former agricultural cooperatives for pension purposes in the relevant social security system", all those persons who have worked in: Former state institutions or enterprises (until October 1, 1993), Former agricultural enterprises (until October 17, 1992), Agricultural cooperatives (until July 19, 1991) benefit from this law.

The law comes to the aid of citizens who have been denied a pension due to a lack of years of insurance, or those who have had periods of work that were not previously recognized by the Social Security Institute, or who have been dragged into legal cases for years.

The regulation stipulates that the request for treatment is made only through the e-Albania portal, in the "Pension Application" service, where the applicant must select the option to be treated according to Law No. 7/2025.

The categories that benefit from the implementation of the law are:

Those who have reached retirement age after the law entered into force;

Persons who have not yet received a pension, even though they have reached the age of majority;

Applicants who have been denied a pension due to lack of insurance period;

Pension beneficiaries who have not been recognized for several years of service and have filed an appeal;

Persons who are in legal proceedings for the verification of periods of employment.

To benefit from the law, the regulation stipulates that applicants must submit documents such as:

Family certificate of the relevant period, proving residence; Criminal certificate, proving that the applicant has not been convicted for non-political reasons during that time, etc.

Any request for recognition of years of service for pension purposes will be reviewed by the Social Security Institute according to standard pension benefit procedures.

PART OF THE REGULATION

Periods of employment in former state-owned enterprises

The general insurance period is recognized, for pension purposes in the social security system:

a) the period of employment in institutions or former state-owned enterprises; i) from the age of 18 (eighteen) years, until 1.10.1993, the date on which Law No. 7703, dated 11.5.1993, “On Social Security in the Republic of Albania” entered into force; ii) from the date of completion of higher education until 1.10.1993;

b) the period of employment in former agricultural enterprises, from the age of 18 (eighteen) years, but not earlier than the date of establishment of the former agricultural enterprise according to the decision of the Council of Ministers in implementation of point 1, article 9, of law no. 7/2025, until 17.10.1992, the date on which decision no. 452, dated 17.10.1992, of the Council of Ministers, “On the restructuring of agricultural enterprises” entered into force;

c) the period of employment in former agricultural cooperatives from the age of 18 (eighteen) years, but not earlier than the year of the establishment of the agricultural cooperative, until 19.7.1991, the date on which Law No. 7501, dated 19.7.1991, “On Land” entered into force.

Who benefits?

Article 5

a) persons who have acquired the right to a pension from the date of entry into force of Law No. 7/2025 onwards;

b) until the date of entry into force of Law No. 7/2025, they have not yet been assigned a pension regardless of the date of reaching the age for old-age pension or the legal criteria for other pensions administered by social security;

c) their request for pension allocation has been rejected due to failure to meet the legal criterion of the minimum insurance period, regardless of whether or not the decision of the Benefits Branch has been reviewed in the administrative appeal process pursuant to Article 86 of Law No. 7703/1993, as amended;

ç) a pension has been granted, but the beneficiary has been sent an official decision/letter not confirming the declared employment periods, subject to Law No. 7/2025, against which he (the beneficiary) has filed an appeal and the practice on the date of entry into force of this law is under review at the KRA, KQA or when the request for review is made within a year from the date of reaching the age for old-age pension or the legal criteria for other pensions administered by social security;

d) are in legal proceedings for the recognition/certification of periods of employment subject to Law No. 7/2025.

How to make a request

Article 6

1. The request to be treated according to Law No. 7/2025 is made through the request for pension assignment in e-Albania, in the "Application for pension…." services, by selecting in the form that appears upon using this service the relevant element to be treated according to Law No. 7/2025.

2. The administration, review, evaluation and decision-making regarding the request submitted pursuant to point 1 of this article shall be carried out according to the same rules and procedures that are provided for the determination, administration and payment of pensions in the social security system.

Criteria and documentation

Article 7

1. Recognition for pension purposes of the insurance period under Law No. 7/2025 is made on the condition that the applicant: a) during the period subject to Law No. 7/2025, has not been serving a sentence of imprisonment for non-political reasons;

b) to have resided in the city, according to the applicant's declaration for the recognition of insurance periods in state institutions or former state enterprises

c) to have resided in the territory where the agricultural enterprise carried out its activity, according to the decision of the Council of Ministers in implementation of point 1, article 9, law no. 7/2025, according to the applicant's declaration for the recognition of insurance periods in former agricultural enterprises

d) to have resided in the village, according to the applicant's declaration for recognition of insurance periods in an agricultural cooperative.

2. Proof of residence for the purpose of recognizing the period of employment according to Law No. 7/2025 is made by means of a family certificate of the required period and subject to this law, which is administered through electronic systems by the responsible employees of the structures of the Social Security Institute.

3. In cases of periods required in state institutions, as provided for in letter “b”, point 1, article 3, of Law No. 7/2025, the applicant submits a certified copy of the original of the higher education diploma.

4. The responsible employees of the Social Security Institute, for the purpose of recognizing insurance periods according to Law No. 7/2025, in application of letter “b”, point 2, Article 3; letter “b”, point 2, Article 4 and letter “b”, point 2, Article 5, of this law, also administer the certificate of judicial status that certifies that the applicant has not been convicted for non-political reasons in the requested period subject to this law./ Monitor Magazine
