Full decision/ Constitutional Court repeals amendments to Parliamentary

The Constitutional Court decided today to accept the request of 1/5 of the deputies to repeal the decision of the Assembly's Rules of Procedure, which concerns the reduction of Parliamentary Committees.

The full decision of the Constitutional Court :

“The Constitutional Court of the Republic of Albania (the Court) on 10.02.2026 examined in a public session the case with the petition of no less than one fifth of the deputies of the Assembly of the Republic of Albania with the subject: “Abolition of decision no. 57/2025, dated 16.09.2025 of the Assembly of the Republic of Albania “On some amendments to the decision of the Assembly no. 166, dated 16.12.2004 “On the approval of the Rules of Procedure of the Assembly of the Republic of Albania, as amended”, as incompatible with the Constitution of the Republic of Albania.

Suspension of decision no. 57/2025, dated 16.09.2025 of the Assembly of the Republic of Albania “On some amendments to the decision of the Assembly no. 166, dated 16.12.2004 “On the approval of the Rules of Procedure of the Assembly of the Republic of Albania, as amended”, until a final decision is issued”

The court convened on 23.02.2026 and, after considering the claims of the parties, assessed that, as far as the basis of the applicant's claims is concerned, the annulment of decision no. 57/2025 should be decided, due to the violation of the principle of representative democracy related to the freedom of expression of deputies as a result of the violation of the rules for convening the Assembly meeting as well as the procedure followed for the approval of the act under review.

The Court also decided that the effects of this repeal will enter into force 30 days after the publication of the decision in the Official Gazette, so that during this period, the Assembly will have the opportunity to organize parliamentary committees according to the standards for the procedure for the adoption of acts set out in the reasoning of this decision.

For the above reasons, at the conclusion of the examination of this case, the Court, unanimously, decided:

Acceptance of the request

Repeal of decision no. 57/2025 of 16.09.2025 of the Assembly of the Republic of Albania “On some amendments to the decision of the Assembly no. 166, dated 16.12.2004 “On the approval of the Rules of Procedure of the Assembly of the Republic of Albania, as amended”, as incompatible with the Constitution of the Republic of Albania.

The repealing effects of this decision enter into force 30 days from the date of publication in the Official Gazette.

The final decision will be announced with justification within the legal deadlines provided for by Law No. 8577, dated 10.02.2000 "On the organization and functioning of the Constitutional Court of the Republic of Albania", as amended by the Regulation on Judicial Procedures of the Constitutional Court./CNA
