Letter orders, security measures in absentia and confiscation of assets/ Braho

The Head of the Special Prosecution Office, Klodjan Braho, has provided clarifications to members of the High Prosecutorial Council on several key issues related to the institution's activity, including letters rogatory, security measures in absentia and confiscation of assets.

Braho stressed that one of the main concerns is related to the status of specialists who cooperate with foreign authorities. According to him, many investigative actions are carried out by them and it is necessary to regulate this impasse by law. He stated that a clear status for specialists would help reduce the workload of investigators, avoiding unnecessary administrative procedures.

"What we have requested is to look at the status of specialists who are in relations with the outside world. Many actions are carried out by them. We think that the impasse should be regulated by law. If the specialists have the status, it will mean that the investigators will not be burdened with the procedure," said Braho.

Speaking about security measures in absentia, Braho explained that SPAK has made a data separation to identify executed and unexecuted measures. According to him, persons who evade justice represent cases where the need for security measures is higher and the decisions are justified.

He also added that SPAK does not have specialized structures for the execution of security measures. “SPAK makes the request, takes the measure and waits for the decision to be executed,” he said.

"We have divided the number in the table, to look for measures that have been executed and those that have not been executed. This is to distinguish this situation. Persons who are hiding from justice are in conditions where the security needs are higher and the measure is fully justified. We have made the differentiation to show the differentiation of criminal offenses.

As is known, SPAK does not have specialized structures dealing with the execution of security measures.

Regarding the confiscation of assets, Braho stressed that there is a significant difference between the number of assets seized and their value. He explained that the report reflects the seizures carried out during 2025, as well as the confiscations by final decision for the same period.

According to him, some of the high-value assets are still under investigation or trial and cannot be considered confiscated until the cases are concluded. He also emphasized that not every seized asset necessarily ends in confiscation, while most of the measures are related to preventive seizures during criminal investigations./ CNA
