Defamation complaint by prison officer/ GJKKO sets verdict for Flamur Noka

The Criminal Court of Kosovo (GJKKO) today issued a decision for Democratic MP Flamur Noka, who was criminally charged with defamation by Peqin Prison officer Gjergji Vishkulli on October 21 of a year ago.

According to the panel of judges led by Judge Rudina Palloj, the opposition MP was declared innocent. 

The decision of the GJKKO:

"1. The injured party, Gjergji Vishkulli, on 21.10.2025, filed a request with the Court, accusing the deputy, citizen Flamur Noka, in the capacity of Secretary General of the Democratic Party in the Republic of Albania, and subject:

"1. The guilty plea of ??the defendant defendant for the criminal offense of defamation committed publicly. 2. The obligation of the defendant defendant to refute the public denunciation published on the Facebook address of the defendant defendant Flamur Noka at his own expense in all national media, by publishing the court decision regarding the object of the search and the reasoning carried out by the court."

At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime with a panel composed of judge Rudina Palloj, based on articles 59, 379, 384 and 388/1 of the Criminal Procedure Code, as well as article 120 of the Criminal Code, with decision no. 30, dated 08.04.2026 decided:
The declaration of innocence of the accused Flamur Noka, accused of committing the criminal offense of "Defamation" committed publicly, provided for by article 120, paragraph 2 of the Criminal Code, since the fact does not constitute a criminal offense.
Court expenses as incurred.
An appeal may be filed against this decision at the Special Court of Appeal for Corruption and Organized Crime, within 15 days, starting this deadline from the day after the communication of the reasoned decision. /CNA
