Instruction banning the use of phones by students and teachers comes into effect

A new instruction from the Ministry of Education published in the Official Gazette prohibits the use of mobile phones and other connected devices by students and teachers in all pre-university educational institutions in the country.

According to this instruction, students will not be allowed to use mobile phones while on school premises. The devices will be handed in to the appropriate boxes in the classroom at the beginning of classes and will remain turned off or in "Airplane" mode until the end of the lesson.

Teachers are also prohibited from using phones during class, except in emergency cases or for pedagogical reasons approved by the principal.

The instruction stipulates that in case of violation, the device is taken by the teacher and handed over to the principal. The parent is immediately notified and comes to school to withdraw the device. In case of repetition, disciplinary measures are foreseen such as participation in awareness activities or more severe measures for high school students.

Parents have an obligation to cooperate with the school, be informed about the rules, and ensure that their children do not use their phones while at school.

The implementation of the guidance is based on national and international principles and is part of efforts to increase discipline, improve concentration in learning, and strengthen direct communication between students and teachers.

What does the instruction stipulate?

PROHIBITION OF THE USE OF CELLULAR PHONES AND PHONE-CONNECTED DEVICES

The use of mobile phones and related devices by students during the learning process and while staying on the premises of the pre-university educational institution is prohibited.
The use of mobile phones and related devices during class hours is also prohibited for teachers, except in emergency cases, as defined in the school regulations or when the use is directly related to proven pedagogical or organizational needs of the learning process permitted by the school directorate.
Any device found or used in an unauthorized manner on school premises is taken by the teacher and handed over to the school directorate, until the end of the class.
Except for urgent needs, students may communicate with their parent or persons exercising parental responsibility, only with the permission of the custodial teacher/school director. School directors are available to enable mutual communication between the student and the parent in any emergency case provided for in the school regulations.

RESPONSIBILITIES OF THE SCHOOL DIRECTOR

The directorate of the pre-university educational institution (school) has the duty to: a) provide in each classroom a box/drawer for the storage of mobile phones and related devices, in cases where the student has taken them to school. The mobile phone must be turned off or in “Airplane” mode and must be placed in the designated box in the classroom at the beginning of the learning process and until its end; b) the teaching staff is responsible for implementing the rules in the classroom according to the definitions made in the internal school regulations; c) to define in the internal school regulations the duties and responsibilities of school principals, teachers, security and psychosocial service officers, students, parents, which are related to the implementation of this instruction; d) to ensure that this rule is communicated to all students and parent(s) or persons exercising parental responsibility at the beginning of the school year; e) to organize meetings with parents, to inform them about the rules and the importance of their implementation. The parent must confirm that he/she has been informed and accepts this rule; f) inform, according to the provisions of the school's internal regulations, the parent or the person exercising parental responsibility for the student, through the digital communication notebook in the Pre-University Information Management System (SMIP), about the prohibition of the use of mobile phones or devices related to them throughout the learning process; g) periodically report on the implementation of this instruction to the local office of pre-university education (ZVAP) on the results of the implementation of this instruction and the measures taken.

ROLE AND SHARED RESPONSIBILITY OF PARENTS OR PERSONS WHO EXERCISE PARENTAL RESPONSIBILITY FOR THE STUDENT

The parent or person exercising parental responsibility must cooperate with the school in implementing this instruction, committing to ensuring that the student does not bring or use a mobile phone or related devices while at school.
In the event that the parent or person exercising parental responsibility requests to provide the child with a mobile phone or related devices at school, the parent or person exercising parental responsibility must notify the school principal of the reason for the device at the beginning of the school year and must commit to informing the child that the mobile phone or related device will be turned off or placed in “Airplane” mode in the designated box/drawer in the classroom/school and will not be used for any reason during the learning process, except for cases foreseen in cooperation with the school principal and specified in its internal regulations.

PROCEDURE IN CASE OF VIOLATION

The directorate of the pre-university educational institution, in case of violation of this instruction, is obliged to immediately notify the parent or the person exercising parental responsibility, through the Pre-university Information Management System (SMIP) and other school communication tools. 2. The mobile phone and the devices related to it will be returned to the parent or the person exercising parental responsibility of the student, after school hours, at the time when the parent or the person exercising parental responsibility appears at school and the student is communicated in writing the measure taken by the pre-university educational institution.

MEASURES IN CASE OF VIOLATIONS

In the event of a first violation of this rule by a student, the measure taken will be a “counseling” accompanied by a note from the teacher in charge, who notifies the parent in writing and through the use of the digital notebook in the SMIP. This notification also includes the collection and delivery of the mobile phone or related devices to the directorate. The parent, after notification, appears at the school to collect the mobile phone and/or related devices.
In the event of repetition of this behavior by the basic education student, it is considered a repeated violation and the following measures will be taken against him: a) counseling through the School Discipline Committee in the presence of the student and the parent; b) participation of the student in special educational and counseling classes/activities or in community activities related to civic and digital education in cooperation with school clubs, of which the parent is also informed.

In the event of a repeat violation by a high school student regarding the prohibition on the use of a mobile phone or related devices, it will be considered a repeated violation and disciplinary measures will be taken against him in an escalating manner, as set out in the school's internal regulations.

Pre-university educational institutions, in order to effectively implement this instruction, in addition to the measures set out in this chapter, may add to their internal regulations other measures for students, of an awareness-raising, sensitization and educational nature./Monitor
